Not sure I agree with this but I do wonder how we could assess the shooter as sane enough to sit trial for his crimes. Anything that can kill 17 people in cold blood is INSANE and should simply be locked up for life or executed. Maybe that’s what DeSantis is saying.
A murder that has no doubt….should be a trail in two weeks…appeal in a week..
Hanging in public a week after the appeal…

I do not believe that people who kill 17 people are insane.
We have soldiers who do that and we kill animals and we don’t say any of those people are insane.
You can be perfectly sane and do all sorts of crimes.
If they are insane, as you believe, it is immoral and illegal to kill such persons, generally.
Make sure he goes into the general population where he can be quickly Dharmered or Bulgered
Especially with the death penalty, there's always a chance that at least one juror will pull a jury nullification and vote against it.
I don’t care if he’s sane or not, anyone who is a mass murderer and there is no doubt they did the crime, then execute withing 2 years.
The problem is that we require juries to be unanimous to convict, to acquit, and to impose the death penalty.
My suggestion: A decision must be unanimous if reached in, say, the first three days of deliberation. After that, make it 10 out of 12. This would solve a lot of jury problems

Jurors need to be death penalty qualified in Florida for cases where it could be the result. I would not qualify. It appears the juror lied here.
Competent to stand trial and not guilty by reason of insanity are not the same. The real question is whether the defendant have the ability to comprehend what they did was wrong and whether they will understand that the punishment is for that wrong. The mens rea element is what they intended to do, not whether they realized the crime they committed would create as much havoc as it did, or whether they agree with the punishment or that they feel guilty for committing the crime. Otherwise, there wouldn’t be any felony murder statutes. Many states have a “Guilty but insane” verdict for cases where the person is crazy, but clearly guilty as well.
The guy, Richard Farley, who shot up my company has been on death row since around 1990. He’s in California, so he won’t ever be put to death.
So has our local ‘Serial Killer’ Frank Athen Walls.
He was convicted in about the same time..............
If the girl believed he was insane, then why did she vote to convict him?
He was not tried for the crime because he pled guilty. The jury only heard arguments for the penalty phase.
The left cares deeply about criminals getting the death penalty but are totally in for killing unborn babies.
