A two tiered judicial system is no judicial system.
This has nothing to do with that. The court just found that some of the people who testified shouldn’t have. He’s still going to be in jail for other crimes and he’s going to be retried on this case.
He’s not going free. He’s still in prison on crimes he was convicted of in California, and he’s going to be retried on these crimes. The court only ordered a new trial, it didn’t free him of the charges.
Nope, very shrewd move. Allows a conviction, and a reversal on appeal.

They allowed women who were not part of the charges to testify against him with their own allegations
But don’t worry he’s got 16 calendars in California too
And New York will likely retry him given theirs career in it for the state attorneys

I have a friend who experienced similar collaborative testimony on a pot case which resulted in sentencing jumping from 60 months to 240 months
It was overturned
He was released from Jesup FCI after 7 years when the ruling came down
Essentially a deckhand testified he overheard him agreeing he’d take 2000 ponds a trip which bumped his guidelines up to 24,000 pounds
But he was caught with 1200

The timing of this and with regards to a NY appeals court is rubbing it in Trumps’s face. Weinstein will get released but they will jail Orange Man Bad.

Trial by news coverage and social media didn’t work. It just made them sloppy.
IIRC Harvey’s defense was that he was not a rapist, he was a John and all the sex was transactional. Seems an appeals court may have agreed.

I am certain that allowing testimony on allegations not part of a case would be found to be prejudicial against a defendant no matter the politics of the judge. Remember it is the rights of the defendant that are protected under the Constitution. Even defendants who are scumbags.
I think enough evidence can be presented without such testimony that a new trial will easily lead to a conviction.
Weinstein could have passed himself off as transgender. Plus, there are no fixed genders. The whole trial was a humbug job, uh, so to speak.
