NEW YORK (CNNMoney) -- Wendy's is taking a bite out of Burger King in the fast food business. Dave Thomas's restaurants became the No. 2-selling hamburger chain in the country last year, industry research firm Technomic said Monday, pushing Burger King back to the No. 3 spot. Burger King had been No. 2 spot since at least 1972, the earliest year for which Technomic has data. Wendy's (WEN) U.S. sales totaled $8.5 billion last year, edging out Burger King and its $8.4 billion. Wendy's has roughly 5,900 locations in the U.S. compared with Burger King's 7,200. Just what this country needs: a Whopper and fries delivered to its front door. Burger King, in a bid to catch up with McDonalds and take a bite out of the competition posed by fast-food rivals such as Wendys, is experimenting with home delivery. Customers can order online or by phone, and the next thing they know -- ding-dong! -- dinner is at the front door.

Burger King is testing delivery in a few Washington, D.C. area restaurants as part of a test that will include 16 restaurants by January 23. The fast food chain, however, did not provide details on the timing of a national rollout. Burger King already has successful delivery programs around the world, including in Mexico, Turkey, Brazil, Columbia and Peru, Burger King spokeswoman Kristin Hauser said in a statement.

The former U.N. weapons inspector convicted in an online sex sting has been sentenced to 1½ to 5½ years in state prison. According to USA Today. the fast-food chain is de-throning its "king" character as it gives its menu more fresh, healthy options. So -- no more commercials featuring that frozen smile. DETROIT -- Detroit police say a 20-year-old Burger King employee who was arguing with a customer punched the 67-year-old man, who fell and later died. Police spokesman Yvette Walker says the older man was reportedly causing a disturbance Thursday afternoon at the restaurant on the city's east side, tried to hit the employee and the employee swung back. WJBK-TV reports police say the punch may have caused the elderly man to choke on his dentures.
