State Sen. Anthony D. Galluccio has failed random alcohol tests - blaming his toothpaste - while on home confinement less than a week after pleading guilty to a hit-and-run crash in Cambridge. A judge could rule as early as tomorrow if the Cambridge Democrat should be sent to jail for violating terms of his sentencing. Galluccio pleaded guilty Friday to an Oct. 4 hit-and-run accident that injured two people, including a 13-year-old boy.

Police in Cambridge, Mass., gave state Sen. Anthony Galluccio a ride home because acquaintances told them he was too drunk to drive about 13 hours before he was involved in a hit-and-run accident. Police were called to a gas station in Cambridge about 4:40 a.m. Oct. 4 after receiving a call about an intoxicated man. A Cambridge city councilor who caused a multiple car crash in December will not face charges, despite reports from witnesses who said he was drunk. NewsCenter 5's Janet Wu reported that a clerk magistrate ruled Friday that Boston police did not follow proper procedure at the crash scene, and no charges will be filed.
