Jussie Smollett's lawyers told an Illinois appellate court Tuesday it should toss the former “Empire” actor’s convictions for staging a racist, homophobic attack against himself in 2019 and then lying about it to Chicago police, arguing that anger over the case led to properly dismissed charges being improperly restored. CHICAGO — Jussie Smollett’s attorneys asked for a mistrial Thursday after the judge called their evidence irrelevant in front of the jury and “physically lunged” at one of the actor’s lawyers. The odd fracas came in the midst of the defense’s cross-examination of Olabinjo Osundairo, who claims he was paid to help Smollett stage the hate crime, as attorney Tamara Walker grilled him about his alleged homophobia and past derogatory remarks toward suspected gay men. Defense attorney Nenye Uche said two brothers attacked Smollett in January 2019 because they didn’t like him and that a $3,500 check the actor paid the men was for training so he could prepare for an upcoming music video — not as payment for staging a hate crime, as prosecutors allege. Uche also suggested a third attacker was involved and told jurors there is not a “shred “ of physical and forensic evidence linking Smollett to the crime prosecutors allege. “Jussie Smollett is a real victim,” Uche said.
