In Florida, U.S. District Judge Kathryn Kimball Mizelle has ruled that the federal law prohibiting people from possessing firearms inside post offices is unconstitutional. The ruling is based on the 2022 Supreme Court ruling New York State Rifle & Pistol Association v. Bruen recognized a person’s right to carry a handgun in public for self-defense.The case concerned Emmanuel Ayala, a U.S. Postal Service truck driver, who had a concealed weapons permit and held a Smith & Wesson 9mm handgun in a fanny pack for self-defense. When police tried to stop him, he ran and struggled with officers. While dismissing the...

After the initial message out from mountain towns looking to learn more about what it would take to sue the United States Postal Service, the towns of Avon, Buena Vista, Parachute, Silverthorne, Snowmass Village, and Steamboat Springs, along with the town of Crested Butte have all retained the services of Kaplan Kirsh Rockwell LLP as their chosen team to look further into a lawsuit. She's not frustrated with the staff themselves but frustrated with the way that they are supported by the USPS, or the lack...

In the 2018 election, about 42.4 million ballots were mailed to registered voters. Of those mailed, more than one million were undeliverable, more than 430,000 were rejected, and nearly 10.5 million went missing. The 2016 election...

Yesterday the Tenth Circuit heard oral arguments in Bonidy v. United States, which is an as-applied challenge to the U.S. Postal Service regulation which completely prohibits firearms on all postal property, including parking lots. Mr. Bonidy lives in Avon, Colorado, and has a concealed carry permit issued pursuant to Colorado law, following a fingerprint-based background check, safety training, and the County Sheriff’s determination that he does not pose any threat to himself or others. The post office does not provide home delivery in Avon, so residents must go to the post office to pick up their mail from a box....
