Nobody has the power to vilate laws of economics, either. And one thing you'll find is that any corporation large enough to tolerate EEOC nonsense isn't going to be terribly competitive. In that sense, idiotic Federal regulations may be a blessing in disguise -- they always ensure that a small organization will operate more efficiently than a large one.

I don't think it pays to minimize the degree to which socialist policies and practices erode common sense and penalize and discourage the performers on the right hand side of the bell curve. There's a "point of no return" that Russia and Germany learned about in 1912 and 1938 respectively. Anyone who says "It can't happen here" hasn't read enough history.
