Suit: Man Died After Falling Into Deep Fryer at Gwinnett Publix

A Commerce woman has filed a wrongful death lawsuit against Publix, claiming the grocery chain was at fault when her husband fell into a deep fryer, leading to his 2015 death.

Mansur Blount was a vent hood technician. Part of his job was to clean vent hoods at client businesses, including a Publix location in Dacula, where he was doing that work on June 25, 2015, according to the lawsuit.

A Publix spokeswoman said it is the company’s policy not to comment on open lawsuits.

Terrible way to die. Publix ain’t at fault. You aren’t supposed to stand on any service. Have a friend that does this kind of work. He has his own ladders and surface covers. He either ignored his training or his employer ( an outside vendor) is at faulr

Is this a training issue? A signage issue? The article claims, that the lawsuit claims, that the worker was unaware of the hazard.

It would appear the the decedent was not following safety precautions and should have known that as a vent hood technician, he would be working over heated surfaces or vats.

However, Public does have some liability here and will likely be writing a check.

And Public went a little far when they on that very day, they advertised a special on fried legs and thighs.

When you have contractors working on your property, you need to make sure they are insured and it’s a good idea to make sure they are following safety precautions.

This is not a matter of lack of insurance. By statute, the Publix contractor’s Workers Compensation insurance was the deceased worker’s sole remedy against his employer. His widow is now trying to pick Publix’s deeper pockets, hoping to prove that some negligence act or omission by Publix led to her husband’s death. Since Publix paid the independent contractor for its knowledge and expertise in performing the contracted work, the store appears to have an excellent defense in this case.

A few decades ago a guy tried to burglarize a fried chicken joint in Memphis by sliding down a vent. He realized he was over a vat of hot grease but he was stuck and couldn’t climb back up. He was found dead the next morning hanging in the vent pipe with his legs knee deep in the hot grease.
