Has ANYONE ever been imprisoned for smoking pot?
09/21/02 | Libloather

Liberteens come, and Liberteens go. But they seem to have an awful time with their own (and biggest - maybe only) issue - pot.

As far as anyone can tell, not ONE person has been placed behind bars for smoking pot. But the Liberteens paint an entirely different picture. They claim that HUNDREDS of THOUSANDS are behind bars for smoking.

Can anyone provide any proof either way?

The quote that ("Trafficking" includes "possession with intent to distribute.") is totally misleading regardless of it’s source.

The difference between possession and possession with intent to distribute is determined by weight in possession. The difference between possession/possession with intent varies widely across the nation. In some large metropolitan counties with multiple jurisdictions, it’s not uncommon for there to be five or more weight standards defining possession with intent (on this block it’s simple possession, go down three blocks it’s possession with intent).

With very, very few exceptions, possession is a simple misdemeanor no different then jay walking. Very few people spent any significant jail time for this level of misdemeanor. Now, possession with intent to distribute, or in some jurisdictions in a school zone, becomes gross misdemeanor or felony; again, this is usually determined by amount and circumstances.

To say that there are this many people presently incarcerated for simple possession is either ludicrous or they are all confined to a couple of jurisdictions somewhere that no one’s ever heard of.

Dood, please answer the question - Has ANYONE ever been imprisoned for smoking pot?

having fun with semantics I see.

"As far as I know, ironically, there is no law that prohibits smoking marijuana."

smoking is the verb, marijuana is the noun, and the object of the verb. Possession of this object is predicated on the verb.

it is not illegal to smoke (or eat) banana peels, and none ever claimed it was. Thus, you initial premise "the Liberteens paint an entirely different picture. They claim that HUNDREDS of THOUSANDS are behind bars for smoking."

is just silly. Not true, never happened, and is whats known as a "straw-man argument".

Wanna try again? Please don't... that was lame.

Gravely concerned about the plight of our would-be hemp farmers and industrialists, are you?

Yes, industrial hemp is one of the great economic issues of the age. I can well imagine why thusands if not millions of Americans would want to march on Washington to plead for the freedom of our hemp farmers.

I spend hours each week disucussing with my kids the many productive uses for hemp. They are bewildered that such an important crop would be on the federal blacklist. "Dad," my ten year-old asks, "Why do the statists deny me the right to purchase quality hemp? I can think of a lot of fun and completely legal things I could do with, say, 60 pounds of hemp and a magnifying glass. But instead I have to play with this boring Saturn Playstation. It just isn't right Dad. It just isn't fair."

Sadly, I have no answer for him. Maybe Ayn Rand does. I shall go back and re-read "Atlas Shrugged" for fresh insights.

FWIW, I knew a couple of guys from HS that had just turned 18 and got caught in, or I should say ON Hampton Beach, NH. Mid '70s. Came close.

The reefer madness took hold of one. He went on to law school. Then to prison. Embezzlement. Needed to pay for his cocaine madness.

YES. My nephews, for one example. See my post in this thread.

I didn't read of anyone smoking anything. You got some more stories?

I have 2 nephews that did 11 months and 29 days in a Nashville jail in the early 80's for that very offense.

So you know of two who spent less than a year in jail (not prison). That's hardly "tons."

And rather than take your claim at face value I would like to review the record of trial and see the whole story. I wager there is more stink to their story than you're letting on.

Has anyone made that claim?

tpaine has, as has realpatriot71, unless you were only asking for rational, credible sources. ;)

The question is - Has ANYONE ever been imprisoned for smoking pot?

Do you have an answer? (Careful - the entire Liberteen society hinges on your opinion...)

I know - I blew it. When your post become relevant, I'll let you know - eh?

No need for that. You go work on it, and we'll let your eventual mastery of subject-verb agreement be your private little triumph.

Hopefully.
