Walmart Employee Who Shot Fellow Employee In The Head At Work Is Exonerated

A Walmart employee who shot a co-worker in the head on a loading dock while at the store has been released. The County Prosecutor said that 49 year old Craig Schmidt acted lawfully under the Montana’s “Castle Law” Doctrine. Under that law, a person has a natural right to use firearms in self defense, and doesn’t have to call 911 before using what is considered justifiable force.

Schmidt was facing charges of assault with the firearm, but the law's existence required that the police investigate further to see if Schmidt believed his life was in danger. That further investigation showed that Schmidt was within his rights in drawing and firing the firearm.

Schmidt and 32 year old Daniel Lara got into an argument about Lara taking an extended break. Schmidt bumped Lara’s shoulder. Mr. Lara took that as a beginning of a fight and started attacking him.

Schmidt was shoved around and punched by Lara. Lara also hit Schmidt extremely hard twice in the head. As the hitting and shoving of Schmidt continued, Schmidt was pushed down and fell on a metal rack. Schmidt feared that the next blow would seriously injure him, so he drew his sidearm and fired.

Schmidt said that he couldn’t retreat any further, and was almost on his back. He believed he was in store for a severe beating.

The shooter is 140 pounds. Lara is 210 pounds. According to the article” “His .25 caliber round hit Lara’s forehead, but didn’t penetrate his skull.” I would say that the shooter was being bullied and his life was at risk. Clearly the purpose of carrying a hand gun is to equalize size differences. Well, it worked. I hope this bullet stopping bully is charged with assault and battery. But the article does not say if Lara is charged with anything. He should be.

I see three lessons from this incident:

1. Never punch a man who is ARMED when you aren't. and then two from this jewel:

Either:
2. Never shot a neanderthal in the forehead or. . . 3. Never EVER EVER carry a .25 and think you are ARMED.

My father (a mounted cop in Detroit) use to say if anyone found out you shot them with a .25 cal, they would get really pi$$ed off at you...

My daddy always says, "I hate like hell to shoot a man and then stand there and argue with him."

.25 Auto has less muzzle energy than an ordinary .22 LR rimfire. You're wasting your time.

It's small and light and concealable, but so what. Get one of the little Colts - the Defender or something.

As a matter of fact, my dad was officer of the guard in Naples one fine morning during WWII, when a GI made a break from the stockade (he was accused of rape on an Italian civilian).

Dad hollered for him to stop, he didn't, so dad hauled out his 1911A1 and shot at the guy's feet. He didn't allow for recoil, so he hit the guy in the back of the head.

It knocked him sprawling, and dad was sure he'd killed him stone dead. But the bullet didn't penetrate his skull, it simply travelled around his head under the skin and lodged between his eyes. Knocked him out but otherwise didn't do him any lasting harm.

Never shoot a Neanderthal in the head, etc. etc.

(The AG showed up a couple of weeks later to investigate whether dad violated the GI's civil rights by plugging him in the head. Nope.)

My 13 year old daughter must recite the following, whenever we target practice, "Never carry a caliber for self defense that starts with a number lower than 4." Cheers :-)

I just talked to a fire arms expert (cop) friend of mine. He said that’s not uncommon at all with ball ammunition. He said, if you want to shoot someone, use hollow point and you will have to pick up the pieces to find the hole you made.

I concur. I have a little Berreta .22 that hides in a special wallet holster that has a spot for the trigger and muzzle.

(Idea being -— thug demands wallet — pull it out -— and shoot.)

It’s 7 rounds of .22.

Fired center of mass, for an ultra-concealed weapon, seems better than nothing.
