It is an even HUGER loser argument for the current situation.

The Birthers (now Birth-bots) demanded the COLB — when it was produced, they want to move the goalposts. The original supposed “fake” documents also listed the father as Kenyan, yet few, if anyone, made the “daddy” argument.

Constitutional scholars can argue this until the cows come home, but in the end for the current situation the bulk of law is on the side of the TOTUS-reader.

And, yes, if it was put to them that is where SCOTUS is likely to go.

This IS splitting hairs and beyond almost everyone on this thread.

The difference is I recognize it.

I disagree. It's an academic argument at this point, one with valid points on both sides that will never be agreed upon and will only be "settled" by SCOTUS decision (which will never happen because it won't get that far).

As such, there's really no harm in having a discussion like this.

Now in a practical sense, unless compelling (and I mean really compelling - Watergate-level compelling where close Obama aides are going public) evidence exists that the long-form BC was forged, this should really be a dead issue at this point. I makes no practical/political sense (which I would distinguish as different from strict loyalty/adherence to a particular Constitutional interpretation) to continue.

Why? Because Obama has lost on this. There's no coincidence, imo, that the long-form BC was released so soon after that poll showing that less than 39% of Americans were certain that Obama was born in the US. The Obama political team really REALLY liked this issue because, until Trump came out and hammered it (which, again imo, drove that poll's numbers), it played into their hands and helped in their efforts to marginalize the TEA Party as a wedge-issue between various factions in the Conservative/GOP coalition.

I think this is the right time to do the "declare victory and get out" thing. Close the matter out by making and solidifying points that if Obama had done years ago what he did last week, rather than spending millions of dollars to prevent the LFBC from becoming public, all the controversy wouldn't have happened.
