(ACN) Congressman Jeff Flake got more than he bargained for at a recent Red Mountain Tea Party town hall forum in Arizona. When a member of the audience asked Flake whether or not he believes that Barack Obama is a legal President, Flake tried, in vain, to put the man in his place.

The bottom line is that Obama found a loophole and used it.

Something that shocks a lot of people is the statement that “The constitution is *not* the law of the land”. But this is a true statement. The constitution is the *framework* for the law of the land.

In effect it does two things. It sets up the organization of the federal government and some things that the government should do, and prohibits the government from doing other things.

But it is only the skeleton of government. The government and the law is built on this skeleton. And for everything the government is supposed to do, there must be what are called “enabling” acts, that describe *how* the government is to do things.

The best example of this was the constitutional amendment forbidding the manufacture and sale of alcohol. Prohibition. But the amendment itself did nothing. Only when congress passed the Volstead Act, did prohibition actually begin.

Now I said all this because the constitution clearly says that the president must be a natural born citizen. But congress has *never* created an enabling act to enforce this requirement. And until it does so, anyone who can fool the voters enough can get elected president, even if they are a foreigner.

Once the electoral college has elected him, that is it. He is the POTUS, and may only be removed from office by Impeachment *and* conviction.
