If he wasn't I'd imagine he will be in the future. Most likely he'll not be able to engage in any sort of public speaking engagements for the rest of his life.
Neither will the rest of the majority although Kagan is probably safe going to overweight dieseldyke gatherings ~ as long as she wears her stud suit.

Congress controls what IRS uses its agents for, as well as how many of them it can have.
I'd suggest it will be exceedingly difficult for IRS to get its personnel needs funded in future years ~ even by Democrats.
