Sad story, happy ending. Nothing to do with Obamacare, though. The under-12 rule is the work of the Organ Procurement and Transplantation Network, which was established in 1984 under Reagan. The last time they updated their policies was in 2005, before Obamacare.

Thanks for clarifying this touchy matter. Much as I am disinclined to cut Sec’y Sebelius (sp?) any slack, she was not empowered to break the standing rule. Much more appropriate that the rule be tweaked by a court, even if only on a one-time, ad hoc basis. I doubt that Sec’y S. would oppose a formal change in the current rule.
