Why Not Just Identify Yourself and Avoid Possible Death?

Lisa Mahone and her boyfriend Jamal Jones were driving on Sept. 24 in Hammond, Indiana, with Mahone’s two kids in the back seat when Mahone was stopped and ticketed for driving without wearing a seat belt. The stop was caught on cellphone camera by Mahone’s 14-year-old son.

“Thank goodness Joseph took the video, because the video stands for itself that these officers engaged in excessive force,” attorney Dana Kurtz said in a news conference with the couple Tuesday. In the video, officers ask Jones, who was in the passenger seat, to show his ID. However, he did not have his license on him. Officers then appear to draw guns and order him out of the car, prompting Mahone to call 911. The video shows police shattering the passenger window and using a stun-gun on Jones. Lawyers say the two children suffered minor cuts from flying glass. The lawsuit alleges excessive force, false arrest and battery.

In a statement earlier Tuesday, Hammond police said, “Police officers who make legal traffic stops are allowed to ask passengers inside of a stopped vehicle for identification and to request that they exit a stopped vehicle for the officer’s safety without a requirement of reasonable suspicion. When the passenger displayed movements inside of the stopped vehicle that included placing his hand in places where the officer could not see, officers’ concerns for their safety were heightened.” Mahone said since being pulled over, “I’m really in a state of shock.”

It seems like more and more people are refusing to comply with the pigs, creating a more violent scenario for themselves. We know they hate and fear us, so if a pig is violating your rights by all due respect, film him. Film him, but comply with the request and then use that footage to sue the hell out of him for violating your Civil Rights. But brothers, please please stop challenging them as if they will not shoot to kill us….THEY DO SHOOT TO KILL US. We need to stop making ourselves easy targets and victims. Why the hell did they all not have on a seatbelt? You are breaking the law by not having it on in turn you were stopped. I am in no way excusing the actions of the pigs, but I am saying lets be logical, it could have all been avoided. Say what you will, but if you have your family in the car with you, that is not the time to act like a martyr. This behavior and mentality scares me.

ok, so if not wearing a seat belt is a crime, tell me who was the victim here?

I’m all for treating authority with respect and in many of these cases that is definitely lacking. I don’t think we as Americans should be made to feel like we should be kissing their backsides to keep from being harmed.

If the "officer's" fieldcraft was so sloppy, and his tactical savvy so incompetent as to encourage your insane adviso, then he has no right wearing a badge or gun.

Hair-trigger cowboys like this damnable swine deserve whatever they get, and excuse-making enablers like you are even worse.

IMHO.

I hate seat belt laws and think that they are ridiculous and an unlawful intrusion into a person's right to choose how they conduct their lives.

Despite my disagreement with the law, it is the law and I will be stopped and cited if I don't wear my seat belts when driving.

If you don't like the law, change it.

The police officers in question were within their lawful right to stop a car filled with two adults and two children not wearing their seat belts.

The occupants of the car did not comply with the officers legitimate requests, copped an attitude and argued with the officers.

After escalating a minor traffic stop into a much more serious situation by their refusal to cooperate, refused to leave the car as requested. They ultimately effectively resisted the officers, and acted suspiciously and in a potentially dangerous manner. They are responsible for creating their own situation and are responsible for the consequences.

Having listened to him on several topics, I agree with him more often that not.

Remember when seat belt laws were first proposed?

And do you remember when States voted on these laws?

And remember when the Federal Government threatened to pull funds for highways if the state government didn’t vote a certain way?

And remember when we were told “don’t worry, no one will be pulled over for failure to wear seat belts?

And remember when some who were concerned about civil liberties called Bull Shit?

And remember when all of us were called “paranoid”, chicken littles, cop haters etc. etc. etc.

And remember when, as soon as these laws got passed, well then by golly, by geez, “they” all of a sudden could pull you over for not wearing a seat belt?

Well, I remember. Apparently you don’t.

Seat belt laws were just another excuse to pull people over and search without reasonable cause. If you can’t see that then there is no helping you. But don’t attack the ones who are just pointing that out.

I think I was pretty explicit that I strongly disagree with seat belt laws.

I would like to see them repealed.

Until such time, they are the law of the land.

You are free to debate the legality or wisdom of seat belt laws all you wish, but vigorously and argumentatively doing so at a traffic stop is not the time or place to do so.

If you want to protest, fight the ticket and tell your story to the judge.

However, on the street, be polite,and courteous to the Police officer doing his job and comply with his requests.

Jones lost his license two days before because he didn’t have insurance he has the ticket in a bag to show them but when he reached to grab it from the and not telling the cops what he was going after you can someone will draw bead on your dumb ass.

I may have missed something but that’s why they were pulled over. Also, I’m sorry if I missed where you were “explict” about your disagreement with seat belt laws. Please accept my apologies.

I definitely hate seat belt laws and would like to see them repealed and the elected officials who voted for them removed from office.

Until such time as they are repealed they are the law of the land.

The driver of the vehicle in question was originally pulled over for driving while having herself, her front seat passenger and her two young children in the back seat not having seat belts fastened.

But that was just the start and how the driver of the vehicle and passenger reacted during the stop had a lot to do with what went down.

First off, the driver and front seat passenger were argumentative, uncooperative and resisted the officers reasonable and lawful requests.

The driver at some point put her car in gear, started driving forward and seemingly tried to flee the scene. This is pretty big no-no and a action to avoid at a traffic stop.

The front passenger refused to exit the vehicle, rolled up his window and began rummaging through a bag as if looking for a gun.

Not sticking up for the cops, but there is far more to the story here than we are being led to believe.

From my perspective, race does not seem to be a factor and the police may well have been justified in their acts since the vehicle occupants seemed to do every thing you should never do at a traffic stop.

With this opening line, the author defines his contempt for the police.

If you start with that attitude, trouble will follow and it has nothing to do with blackness, just being a smart mouthed asshole will do just fine.

The cops will put up with some idiots for a while, but 13 minutes of telling the guy to get out of the car is pushing it.

Too bad he got tased, but he really deserved more than being tased.

Good advice. Also, as you said earlier, keep your hands visible. Furthermore, don’t make any sudden movements. There was a poor chap shot in the South the other day who had exited his car in a gas station when a police officer asked for his license. He turned and reached into his car to retrieve his license (in compliance) when the cop drew and shot him. It seems prudent to explain to the officer what your are going to do next in order to comply with his requests/orders.

Indeed, you must assume that any agent of the police state is 'roided up and eager to destroy anything that moves.  Of course, moving slowly is just as likely to result in them freaking out as well, so it's a toss-up. Sadly, this is where we've come to in America. An occupying army that swarms out and harasses the citizens at their leisure so as to generate ever more revenue from the police state. Any encounter not met with meek subservience is a threat to their authoritah, and will be treated accordingly.

I agree that right or wrong the best thing to do is what the cops tell you to do, even if they have no right to.

Having said that, this situation is just one more reason that I hate the cops.

So now it’s illegal to leave your house without your driver’s license just in case a cop demands ‘papers’?

If you don’t have it, you don’t have it. I’m unaware of any law that requires a citizen to carry ID with them every where they go.

And if it’s not illegal to walk/ride without ID, then how can it be legal for them to demand it?

Officers have discretion to demand ID based upon what they observe and the subject’s behavior. The driver and front seat passenger were being uncooperative and acting squirrely.

As I said earlier, if the front seat passenger had kept his hands in plain view and his mouth shut, the cop would not have even talked to him for a seat belt violation, must less demanded an ID.

Asking for an ID is not unreasonable and lawful orders are not based upon whether or not you feel like it.
