Man found guilty of driving zamboni drunk during hockey game

FARGO – A former Zamboni driver for the Fargo Park District has been sentenced to serve 9 days in jail by a municipal court judge for driving a Zamboni while drunk during a high school hockey game on January 30th.

Steven James Anderson's attorney argued at trial his client wasn't guilty of the Class B misdemeanor driving under the influence charge he faced after witnesses reported Anderson was driving the Zamboni erratically during a Fargo Davies girls hockey game against Williston at South Sports Arena.

Prosecutors said Anderson had a 0.314 percent blood-alcohol content that night.

Defense attorney Lindsey Haugen said Anderson wasn't guilty because North Dakota state law doesn't define a Zamboni as a vehicle.

The judge disagreed and found Anderson guilty after about an hourlong trial.

I would think that a better argument is that a hockey rink is not a public road.

Zamboni is an ice-smoothing machine, used to condition the ice on hockey and skating rinks. It is named after the inventor, so it is an “it” and a “who.”

It is a machine that they use to smooth the ice on the hockey rink.

Getting to ride on the Zamboni during a game is fun.

And if it is a roadway, someone needs to be sued for allowing all that ice on it! A person could slip.

There is probably all sorts of case law that broadens the meaning of “public road” to be anywhere the judge wants it to be. Especially your own driveway, but also parking lots.
