The ever entertaining and mercurial Rep. Alan Grayson, D-Florida, threatened to file a lawsuit if the Republican Party picks Sen. Ted Cruz, R-Texas as its presidential nominee in 2016, according to a Friday story in the Washington Times. Grayson made this threat while appearing on Alan Colmes’ radio show. The stated reason for the threat is that, in Grayson’s view, Cruz is not a natural born American as required for being president in the United States Constitution, having been born in Canada, albeit to an American mother.

If the law suit against Cruz was won, would that mean that the Obama years are nulled? tit for tat. Cruz would win though and Obama will lose.

Not exactly. Both Cruz’s parents were citizens ar the time he was born; mother born in U.S. father naturalized several years prior. However, unlike McCain, both parents native born U.S. citizens, was born in Panama which was a U.S. Protectorate at the time and on a U.S. Military base as well, Cruz was born on Canadian soil in a Canadian hospital. However, I do believe he will pass muster nevertheless. But, an early ruling would be beneficial to him I think.

Not accurate. His mom was/is a US citizen, his pops was a Cuban citizen at the time and became a US citizen recently in 2005.

The fact is that this has not been a settled matter of law. SCOTUS has opined on this in an immigration case before Obama issue came to the forefront. When an immigration case came before them later they didn’t dare talk about the topic.
You have to actually listen to the oral argument to understand that SCOTUS has differing views on the topic.

Step Daughter was born in Japan, she held dual citizenship until she was 18. Born on US Navy Base, both parents US Citizens. Yet she had a Japanese BC, an US BC from the US Consulate. US Passport at 3 days old.
She is now 40 and denounced the Japanese citizenship at 18.
How many other Military families have gone through this stuff?
