I don’t think it’s ever been tested but it will be if Ted gets the nomination

So why not get court to rule now

Judges don’t want to ‘declare war against’ female equality regardless of original intent. So Cruz would most likely win every eligibily case, especially after appeals. [Note Valentine’s post 155, but if you are like me and don’t know Latin, good luck trying to understand it.]

That is only one aspect.

Now for political dissent.

People don’t respect judges anymore. People like Glenn Beck have no idea how little the judges’ opinions matter to people.

Obama’s eligibility question already demonstrated that the debate rages on. We and Trump had been up to our necks in it and experienced the political dissent against Obama first-hand. It’s a powerful force of nature — any arguable doubt will open the door to a MOAB of criticism and loathing.

Progressive republicans? I think they would be ‘all in’ for ‘rah-rah’ Constitution when it suits them. ‘Sabotage Cruz.’ Mitch Mc-Con-Man already did.

Democrats? They keep their powder dry. Then if Cruz wins the nomination they become gleeful imps who would run ads to make Cruz supporters look hypocritical, self-contradictory, and divided. [As loony-tunes as possible.] And the Establishment Republicans have already offered them a lifetime of material.

Leftist college students and the New Black Panthers? If people think that we Obama-birthers were bad, they ain’t seen nothin’ yet. Leftist college students and the New Black Panthers would swear blood pacts to undermine Cruz.

In other words — the result would be chaos. Cruz might still win. But his administration would be tainted.

Thursday following FBN’s broadcast of the Republican presidential debate, Harvard constitutional law professor Laurence Tribe attacked Sen. Ted Cruz ... for his stated on reasoning for his eligibility to run for president of the United States.

According to Tribe, Cruz applies a double standard to his interpretation of the Constitution, to which he deemed Cruz to be a ‘constitutional opportunist’ and a ‘hypocrite.’

‘I’ve done a lot of historical research on it, and so have a lot of other people, and the best evidence seems to be that what they meant... ‘

IMO, SCOTUS got it wrong in Wong-Kim-Ark, and children of alien parents are citizens of their parent's country, not of the US.

The 14th Amendment doesn't read "all persons born . . . in the U.S. of parents who are citizens, are citizens of the U.S. . . ." But isn't that effectively how you're trying to mentally re-write it by saying children of aliens should be considered aliens?

There's a lot in the legislative history of the Civil Rights Act and 14th Amendment that anticipates the WKA decision. The Court got it right.

I must have posted a hundred times in the past few days how much I despise Tribe.

But words are not people. Words are vulnerable to attack by smart debators — easy targets. Why can’t Cruz finish off the words Tribe uttered? Obliterate them. Destroy them. Discredit them. Why can’t people on this forum?

Until someone does, Tribe keeps getting stronger.

And I personally think we can afford to consider Canadian born with some US background as eligible. But to avoid all the hair-pulling and squabbles, a constitutional amendment would clear that up. AND ... when democrats and the Ruling Class get in the way of that amendment, we ‘out’ them.

Further, if Cruz wins, the amendment moves forward to vindicate him retrospectively.

I think we could suggest a very narrow amendment ...

Candadian born [maybe Australian as well] with US influence and able to speak English could also qualify. [Some in Quebec refuse to speak English.] And frankly, I myself wouldn’t mind adding Japan and Taiwan. But would 3/4 of states agree?

The amount of US influence could be hashed out by state legislators.

This amendment could be ratified very quickly with the speed of text-networking. The only stumbling block? Creeps who want to ‘game it’ against Cruz via process and due to fear of his patriotism. That is a perverse motivation, and everyone will see obstructors for what they are.

And most likely it would be ratified after the election due to legislative stonewalling. So if he’s elected, he gets vindictated retroactively. A far cry better than the way Obama handled it.

I think your focus upon birthplace is mistaken. In these days of airline travel, a mother can birth a child anywhere and have the kid back at home within a day or two at the most. It's absurd. To me, it is a matter of where and how the child is raised, growing, learning, working, and playing amid other Americans. One can do that even in an embassy compound to a degree, at least when very young. It's a distinction of acculturated loyalty.

Hence, Obama is disqualified regardless of his place of birth because of his rearing in Indonesia, whereas Cruz is clearly American. We all recognize that in their respective characters. That was the point of the requirement in the first place.

I agree. But we need clear boundries. So ... one part of vetting a candidate would be to hear public web-conferencing discussions with a candidate’s family members and religious leaders. The entire process could be codified in a manual referred to in the Constitution.

But that kind of vetting will require massive public deliberation and should focus more on the candidates themselves, such as their opinions while in college [another thing Obama kept secret].

For Cruz right now we need something simple and pragmatic which we can expedite, something narrow that causes little or no harm, and possibly even an expiration date to keep the Constitution from being cluttered if legislators prefer.

Did you see Cruz today on FoxNews Sunday?

He wiped the floor with Chris Wallace on topic after topic, had the creep absolutely stammering. I haven't seen such an amazing exchange on a talking heads show in a very long time.

I don't think Wallace was prepared to have a interviewee capable of making sure he answered every one of his "questions."

I think your post ‘nailed it’ — state legislators will never go for the idea.

Which means ...

The Cruz Eligibility Amendment isn’t going anywhere.

But ...

Symbolic gestures still matter.

Promoting the amendment corners cynical Cruz-critics and allows this forum to heal a little.

I agree with the paradox. We need informed voters more than anything else. But we have to work with the low-info voters we have. Paradox.

Do check out Haga’s Law. It’s a stinker of a book that made a huge difference in my effectiveness as a project manager.
