I've never posted a vanity before so forgive me for any boo-boos. A family member (sister) just let me know about some bad legislation that may be coming her way. Several years ago, her husband went through a mid-life crisis and ended up leaving her temporarily for a younger woman who had a 6 year old girl. Eventually, the woman had sister's husband arrested and convicted for lewd and lascivious behavior in front of the child which is a mandatory 25 year sentence in Florida. My sister is getting ready to retire from K-Mart and planned on supporting herself on her little pension and her husband's federal pension. Now this Republican Senator from Montana wants to push through a bill that states “A convicted pedophile should not receive one cent of taxpayer money while serving time in prison. This cannot stand.” My sister is not a pedophile yet this will cause her great financial distress, even losing her house. Does anyone know what can be done to stop this? I've emailed the man but what more can be done? We don't condone what her husband is convicted of, obviously, but what of the innocent families this affects?
That’s gonna be a hard one to stop unless you can find a way to put in that aforementioned exception. Contact the Senator’s office and explain the situation.
Copy/paste this vanity in the form of a letter and email it to each state legislator and senator.
Do weekly follow ups. Find like minded individuals. Enlist their help. Start a grass roots movement.

If you have the language of the bill and either post it or send it to me, I’ll take a look at it. I can’t believe they wouldn’t have provision in the language preventing adverse impact on innocent spouses or children.
Possibly your sister will end up having the husband’s (former husband?) ENTIRE pension payment sent directly to her for her use only.
She needs to write her congressman and both senators.
Your post suggests that this is proposed legislation, not something that has already passed, is that correct?
Is this related to Florida state pensions? Or some proposed federal law?
I can’t imagine that US congress would pass a bill like this, which would pertain to pensions paid by the states.
Without more details about the source of the pension and the status of the pending legislation, it sounds like there is not enough info to panic, IMHO.

An article link above and the text of the bill. My sister has had health issues and the thought of losing her house, etc. has her a nervous wreck. I wish I understood the language of the bill better, and thanks to all of you who have made such worthy suggestions. His story was in the newspaper and she’s taken flack just for being married to him.
We need a little more context (like the text of the bill.)
I doubt the government can tell a private company who it can and cannot pay a pension to.

A BILL
To amend title 5, United States Code, to deny Federal retirement benefits to individuals convicted of child sex abuse.
1.Short title
This Act may be cited as the Denying Pensions to Convicted Child Molesters Act of 2019.
2.Denial of retirement benefits
(a)In general
Section 8312(a) of title 5, United States Code, is amended—
(1)in paragraph (1), by striking or at the end;
(2)in paragraph (2), by striking the period at the end and inserting ; or;
(3)by inserting after paragraph (2) the following:
(3)was convicted of an offense described in subsection (d), to the extent provided by that subsection.

(4)in the matter following paragraph (3), as added by this subsection—
(A)in subparagraph (A), by striking and at the end;
(B)in subparagraph (B), by striking the period at the end and inserting ; and; and
(C)by inserting after subparagraph (B) the following:
(C)with respect to the offenses described in subsection (d), to the period after the date of conviction.

(b)Offenses described
Section 8312 of title 5, United States Code, is amended—
(1)by redesignating subsection (d) as subsection (e); and
(2)by inserting after subsection (c) the following:
(d)The offenses to which subsection (a)(3) applies are any offense—
(1)within the purview of section 2241(c), 2243(a), or section 2244(a)(2) of title 18; and
(2)for which the conduct constituting the offense is committed on or after the date of enactment of the Denying Pensions to Convicted Child Molesters Act of 2019, which shall include any offense that includes conduct that continued on or after the date of enactment of such Act.

(c)Absence from United States To avoid prosecution
Section 8313(a)(1) of title 5, United States Code, is amended—
(1)in subparagraph (A), by striking or at the end;
(2)in subparagraph (B), by striking and at the end and inserting or; and
(3)by adding at the end the following:
(C)for an offense described under section 8312(d); and

(d)Nonaccrual of interest on refunds
Section 8316(b) of title 5, United States Code, is amended—
(1)in paragraph (1), by striking or at the end;
(2)in paragraph (2), by striking the period at the end and inserting or; and
(3)by adding at the end the following:
(3)if the individual was convicted of an offense described in section 8312(d), for the period after the conviction.

Nothing can, or should be done.
Her husband is a pedophile. He’ll lose his pension because of it and rightfully so.
Too bad she was counting on it, and him.
Question for you. Is the husband under CSRS (Civil Service Retirement System), or under FERS (Federal Employee Retirement System)? CSRS was eliminated in the late 1980s when FERS came about. Essentially FERS is like a 401k plan. There is a small pension-like part, and there is social security in the mix, but the majority of the money in the plan is from contributions made by the employee from his/her salary into what is called the Thrift Savings Plan (the 401k part), and that is his money.

A couple of things bother me about your story.
Your use of “This Republican Senator”, for one.
What does that have to do with your story?
And you come on a Conservative site and ask for help based on your story. You are telling us, a Conservative audience, that your brother in law cheated on his wife and then molested a little girl. Your sister then took him back. He then went to prison.
Is this right?
How are we supposed to help you?
The Senator’s Office is going to want to know your name, your sister’s name and your brother in law’s name.
They will want to know when and where he molested this little girl.
Yes, let’s through his innocent wife out of her house because of his actions. How kind you are.
Ex-post facto laws are a conservative value?
I emphasized Republican Senator because I believe Republicans are fair-minded and reasonable (at least conservative-leanng ones) and this bill strikes me as a knee-jerk reaction to a situation involving a doctor who abused boys on an Indian Reservation. I can’t belive a Republican would sponsor such a measure that would hurt innocent family members. Is that so hard to understand? I also have seen kinder members of this forum give solid advice, and, since you don’t seem to be one of them, why waste your time?
Sounds like an ex-post facto issue to me.
Actions have consequences. He should have been taken out and executed. Sorry, no sympathy.
