White House insists Trump has authority to block American companies from doing business in China

White House economic adviser Larry Kudlow asserted President Trump’s threat to block trade between private Americans businesses and China, saying he has “emergency economic power authority” to do so.

“Do you believe that the president does have the authority to block private businesses from investing in China?” CBS News' Margaret Brennan asked Kudlow on “Face the Nation” Sunday.

“Ultimately, he does have authority,” responded Kudlow. “It’s an emergency economic power authority,” he said, adding that Trump “is not intending to” block trade with China at this time.

Amid an escalating trade war, Trump in a series of angry tweets Friday “ordered” American companies “to immediately start looking for an alternative to China, including bringing our companies HOME and making your products in the USA.”

Its pretty common here. Its actually unusual when people know what they are talking about. Most of the time its just opinion based on emotion and knee jerk reaction.

The Constitution enumerates the power of Congress to regulate trade with foreign countries (Article 1, Section 8, clause 3)

Congress then, via the International Emergency Economic powers act (Title 50, §§1701–1707.), granted the office of the President the power to declare a threat to the US Economy.

This authority was used by President Jimmy Carter in response to the Iran Hostage Crisis, presidents have invoked IEEPA to safeguard U.S. national security interests by freezing or “blocking” assets of belligerent foreign governments, or certain foreign nationals abroad.

In addition to the National Emergency Act. (Pub.L. 94–412, 90 Stat. 1255, enacted September 14, 1976, codified at 50 U.S.C. § 1601-1651), which is a United States federal law passed to formalize the emergency powers of the President, there may also be some relevant sections in the authorization of the STOP Act, designed to slow the opioid epidemic. That bill, which President Trump signed into law on October 24, 2018, passed in the House by a vote of 393 to 8, and in the Senate by a vote of 98 to 1. There are also regulations in the Trade Act of 2002 which involve private carriers.

The Constitution trumps Congress (Art. VI, Cl 2). Unconstitutional law and legislation is invalid and should be rejected and ignored.

Yeah, well, past, present, or future, unconstitutional federal acts are acts of tyranny and invalid should be ignored and nullified.

The BIG picture, my FRiend is the restoration of our Free Constitutional Republic. You don’t do that by violating the Constitution as written and originally understood and intended.

Yes, but the original intent of the Commence Clause - to remove barriers within and ensure safety without - has long since been wrested and so violated that the feds now think they have basically totalitarian power.

What is this sht? Judges choosing when he can or cannot use his exec powers on foreign aid or trade? OBama had carte blanche.

THe courts doing that should be disbanded.

I see nothing in the Constitution that gives Trump power to interfere with buyers and sellers between the U.S. and China.

Apparently, the congress passed a law back in the 1970's that gives the President the authority via the use of emergency powers. Since congress has control of commerce, I'd say a challenge to the law congress passed would pass constitutional scrutiny.
