Larry said “No Deals” and I believe him. I think HKS is trying to “appear” to be nice for damage control. He is probably worried that Virgie will get custody (temp or perm).

I find it kind of ironic that the very place they went to shield the baby from LB could ultimately put her in the hands of the person they wanted her away from the most (Virgie)

HKS doesn’t appear to be as bright as people may think! IMO, he is only stonewalling. BRING IT ON HOWIE!!

I’m resting, but there are a few things that need immediate attention, like clean towels, clean stove top (yuck), and a balanced checkbook(double yuck!). I’m not going to do anything too strenuous :)

It’s a diversionary tactic. That’s why this jumble reminds many of us of the Clintons.

HKS, through Lin Wood, is telling media and Jane Q. Public that they’re not permitted to think or speak, just accept what they tell them.

There wouldn’t be such a fuss unless someone was getting close to the truth!

I am working on an “Inquest Update” which contains what has happened to date.

I’ll post info in the forum so it can be searched for later but I will also post the updates on my home page.

“IC” (LOL) Howie shakin in his boots about the inquest. If the inquest jurors recommend cause of death as murder and implicate HKS that COULD lead to a charge of murder against him. If the jury finds criminal activity played a role, it would be up to the Bahamian attorney general’s office to pursue the case. There is no bail for murder in the Bahamas. He would have to sit in the Fox Hill Prison awaiting trial. IMO, this is the reason he is fighting the inquest!

is there not also a conflict of interest - HKS as a private person and HKS as executor are two separate legal entities aren’t they?

If I understand the question correct, the conflict of interest resides in the fact that he stated he had an intimate relationship with a client -- the representation we're talking about is on the Marshall matter. If challenged before the Ethics Committee, he could be fined, suspended or disbarred for that. Which is also why it was put on record in Seidlin's courtroom, on the very first day of testimony, I believe.

The Will will probably be ultimately thrown out on so many different levels after contestation and most legal-heads agree. But ethically, your attorney could be your Executor. The ethic flags goes up because of the intimate relationship an attorney is having with a client and will probably be a point joined to this.

The thinking here is this: The American Bar Association has always maintained that choosing to be intimate with a client leaves the client in a vulnerable position and opens the door for the attorney to exploit the client.

I have no doubt we'll see an entirely different saga when Stern tries to probate the Will.
