Threatening messages are exempt from recording laws.

If you commit a crime over the phone, or the person receiving the message feels threatened, AND the call was not intentionally recorded except on an answering machine, then there is no law broken.

Baldwin really stepped in it.

Hey, he knew the message was recorded. He left a recorded message on her phone. He was stupid.

I didn't know that, but it does raise other questions. I guess he stepped in it. Further down I read the lawyer says it was leaked from a sealed court order.
