Yes and No. Depends on who's court you listen to. Australia claims the waters in question, and they have forbidden all whaling of any kind. The Japanese don't acknowledge Australia's claim to the waters. Australia doesn't enforce their claim so the Japanese can get away with ignoring it.

If your neighbor tells you not to fish in his lake, but you claim that his land ends at the beach and fish there anyways are you breaking the law?

Actually I think it is against international law.

The Japanese don’t say they are whaling for consumption.

They call their whaling ships “research vessels”. They say they are doing “whale research” to get around the law...

So I think what the Japanese are doing stinks and I think Paul Watson is a complete idiot. I’m not sympathetic to either side.

It is illegal. There has been a worldwide whaling ban FOR ALL WHALE SPECIES in effect since 1982, as instituted by the IWC. If we expect Iran and North Korea to abide by international treaties and UN Resolutions, then we should expect the same from Japan. Start reading before you accuse others of emoting.
