Obama is not a Native US Citizen

Meandering through my 1928 Edition of Bouvier's Law Dictionary on page 833, Native, Native Citizen is defined:

Those born in a country, of parents who are citizens.

If Obama does not meet the standards of a native citizen how can he be a natural born citizen.

What plate is the AZ Gov stepping up to?

While the AZ Leg has done great work on illegal immigration and concealed carry, they have tabled a simple requirement to CHECK a candidate’s qualifications and certainly haven’t tackled any move to define NBC.

Meanwhile Brewer is hoping the tax increase on the ballot today passes, while I’m hoping it fails. Should know very soon...

That's a pretty good indication that he knows he's not a natural born citizen of the United States.

Or it is a clever lawyerly slight of hand creating a trap that adversaries are invited to fall into?

Notice that the Obama website doesn't say “governed the status of Obama Sr.’s child BHO II.” It only uses the non-specific term “children.”

Then if you go to the actual BNA of 1948, you find that in that act illegitimate children are explicitly EXCLUDED from the definition of “children.” BHO II could be illegitimate if his parent's marriage was bigamous due to BHO Sr.’s marriage to Kezia.

The 1948 BNA says:

“(2) Subject to the provisions of section twenty-three of this Act, any reference in this Act to a child shall be construed as a reference to a legitimate child; and the expressions “father”, “ancestor” and “descended” shall be construed accordingly.”

Obama and his legal team had two years to prepare to defend his NBC status and floating the BNA of 1948 could have been a tactic in a well-planned strategy.

It was Factcheck who obligingly lept to the conclusion that BHO II was governed by the 1948 BNA, while the Obama campaign never said it thus providing deniability to Obama.

Ahh, Jan Brewer, she of the tax and spend mentality who’s championing leaving State Government intact and hiking taxes on business. Yes, definitely a strong conservative. In fact, she’s been called a RINO right here at FreeRepublic!

Anyone else you consider a real conservative (not a tax-and-spend RINO)?

Chip was claiming we’re basically Democrats, and that every GOP member is a RINO. So I’ve been pushing him to name someone he considers a “real conservative”. And Brewer was what he came up with.

Unfortunately, I believe Chip reflects a very vocal minority of conservatives who are simply angry and don’t know where to direct their anger. They are eating our own, and engaging in tin-foil conspiracies rather than thinking logically and rationally about the facts.

If this continues - and I fear it will - we’ll lose a key opportunity in November to take back one - or both - chambers of Congress.

I agree, it should go to the Court for definition, especially given the ease of travel we have today. However it is defined though - Vattel or English common law - it won't be retroactive to President Obama, meaning he was eligible based upon the inconclusive phrase as it exists today.

That is a matter of conjecture - subject to SCOTUS ruling too. The operable phrase would be:

"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President ...

If Obama was ruled ineligible by SCOTUS - he almost certainly would be removed from office immediately under the 25th Amendment or by impeachment. Congress could NOT let him stay in office - it would destroy the system of checks and balances upon which our government is based. As to the laws, treaties, and EO's he signed, who knows, again - it would be up to SCOTUS. Would they be invalidated ???

Biden would then become POTUS - assuming that SCOTUS DID NOT disqualify him based on a vote for Obama being a vote for him too. If disqualified, Pelosi would be POTUS.

When I first started researching the NBC eligibility question, I had no idea that it might have these POSSIBLE far-reaching consequences. I became convinced that the government [Congress, SCOTUS, or combination thereof] have failed to address this deficiency far too long.

How would they rule ??? I don't know. You know my opinion - I know yours. But, that is NOT the point - the point is that it needs to be resolved [one way or the other]. If SCOTUS were to rule for Obama [and the majority of the public disagreed with it], it could be changed via amendment. If they agreed with it, fine [but I would not be happy about it].

I believe in the Constitution and [when it is found to be deficient], its meaning needs to be clarified or amended - as needed.

Brewer is considered moderately conservative in Arizona. She signed the illegal immigration law, but would have had ZERO chance of remaining Gov if she had not. She also signed concealed carry without a permit - good, but she would have made a lot of enemies if she had not.

OTOH, she has been pushing for a temporary increase in the sales tax - from 5.6% (I think) to 6.6%. Naturally, the world will end and Arizona will blow up if we don’t pass it. Lots of us are less than thrilled - AZ has wildly increased spending over the last 5 years, and getting it back to 2005 levels shouldn’t be hard. Not for a conservative.

Just IMHO. I’m a bit odd, I guess. An Obamabot CIA Psyops agent who thinks Brewer is too liberal for Arizona, although I’d vote for her in the general election without hesitation.

And right now, sad to say, it looks like the increase will pass by a 2:1 margin. I was afraid of this. Since it is a special election, the ONLY thing on the ballot for most of us was Prop 100 - and the unions HAD to vote for it, since it is their bail-out. Many in the general populace that might have voted no were not motivated enough to turn out for a single issue election.

But I’m already forking out $4000 in property taxes, and sure don’t see a reason why our wild spending schools need more of my money.

No, I am not insulting those people. I think they have a good issue, to-wit Obama's failure to disclose, which is probably an attempt to hide some other information that essentially reveals he's ineligible for the office.

What I am patiently trying to point out to you is that these radio hosts have a painfully fragile franchise built up centered on their credibility which Obama and Rahm would love to shatter at one blow, by getting them into a "rope-a-dope" over a nonexistent issue.

They're concerned that the birth certificate may be a carefully laid-and-baited trap, and that going into the "kill zone" of commitment to obtaining Obama's documents will destroy talk radio. They think it's an ambush, a KZ laid to kill off Rush Limbaugh by making him look like Maury Povich. (The liberals already tried once, by going through his trash.)

That's where Medved et al. are coming from. I'm just trying to get you to see their POV (DOES NOT EQUAL "come off of it, stop being stupid", or anything of the sort.)

FWIW I think the Mombasa claim began as a political canard invented by Obama himself, to help overcome the "blackness deficit" identified in his ill-fated run against former Black Panther Bobby Rush. I think he kept up the "I was born in Africa" roorback from the 90's sometime, until 2006 when he decided to run for President, and someone realized the trap.

I think his real problem is in his passport use in his teens and 20's -- he may have been a foreign/dual citizen. If he had an Indonesian passport, then he was claiming Indonesian citizenship, because Indonesia disallows dual citizenship.

I agree on both points; it was a plea to show “he’s black enough”. And it would be a significant problem if he used another passport. However, my understanding of Indonesian law is that - if you are an adopted child, you have to claim the Indonesian citizenship at the age of 18 (there’s like a 6 month window) or you lose it. Much like with Canada and other nations.

If he didn’t claim it, then no passport, no problem. If he did claim it, then he automatically forsook his US citizenship.

Personally, I think the BC issue is a red herring put out to drive conspiracy theories. It’s done quite well at that! What’s a few million dollars to distract a portion of your political opponents, especially in a day and age where you’ll spend $400+ million on a campaign?
