HELENA - A Helena man who was shot to death Thursday morning was denied an order of protection last month and filed for divorce two days before his estranged wife was charged with killing him.

The Independent Record reports 48-year-old Joseph Andrew Gable asked District Judge Dorothy McCarter for a temporary order of protection from Michelle Coller Gable on Sept. 20, alleging she was stalking him.

why in the world would a judge refuse a restraining order? if the roles were reversed, and a woman had been killed by her estranged husband after being refused a restraining order, the MSM would be wetting their dress.

Well, she used a gun, and they hate guns, so there may yet be some dress-wetting.

My son’s soon to ex is a psychotic dope addict. She had her boyfriend break into the son’s trailer, which I own, and steal about a $1000 of electronics they traded for dope. The Chief of Police told me that was legal. People have come here looking to collect her drug debts. Constant harassing calls 24/7. She was supposed to have gone to rehab again today but no. The divorce is final tomorrow. She hasn’t contested it yet. But she won’t stop. And this may sound wrong, but we keep hoping the call will come she has overdosed and is dead, dead, dead. Injecting meth and oxycontin.

That just can’t be true. Women don’t do those kinds of things. He must have driven her to it. You know it’s his fault. It can’t be hers.

No surprise at all. Many moons ago, long after my divorce, my ex tried to enter my house with the police inside. She had called them because I would not give her entry to wake our sleeping son to take him home. Earlier in the evening, I had taken him back home after my weekend visitation and she was nowhere to be found so I took him back home and left a message he would be brought back the next day which also was a holiday.

The police instructed her to stay inside but as I was closing the door from letting them inside, she tried to force the door open and I blocked the way. The police took control of her at that time and one office stayed outside with her until everything was cleared up with them. My son remained asleep in his room.

Two days later I receive a summons for suit for protection for her.

In the hearing, all three officers testified as to the events as stated but she received a protection order filed against me. For a year several of my constitutional rights were suspended. It is a one way street, period.

I understand how you feel, one of my son's had a bad divorce and 17 years later she is still trying to get him to court for one thing or another...the oldest son left her home and came to live with his father at 16, she and her new husband use to come to his house and take pictures but he got the house in the divorce. Unusual...yep...she thought she was going to get everything. He also kept his antique wood boat...good lawyer makes a big difference and he also spent lots of time in the law lib. at the court house...A man heading for divorce has to be pro-active and not just let the lawyers do the job....In 2 years child support stops. He fought like a tiger for his kids and even had the parish priest come to the court on his own for one of the proceedings...

He had the kids baptized when he had them and she called the parish priest and demanded he unbaptized them or she would sue the church...A real gem and I don't know how he lasted 17 years with her.....

Just be thankful you don't live in the skin of the psycho's. If the female left the home, in our state you can legally change the locks...Men, do not leave the house if your heading for divorce. When he left, his lawyer told him to reconcile with her and to not leave the house, she left after they got back together and deserted the home, she didn't get it in the divorce...But check out the laws for yourself in your state....The stories I could tell, she even wanted a share of my IRA cause if I died, he would be one of the beneficiary's...I had to go to court, to straighten that out....

It can be a real nightmare and usually the guy gets the shaft if kids are involved....

You have my sympathy, been there, done that......

My son was granted temporary full custody. Tomorrow, unless contested, that becomes full custody. She called whining she didn’t have the money to contest it and it wasn’t fair to her that she had to submit a clean UA before she could see the kids. She said because of that she would never get to see them. They are 1 and 2 with recent b-days. My son told her that it wasn’t about her. It was about the kids. She didn’t get the kids anything for their b-days, but she gets her dope. My son moved back in with us until he can get the problem with his hearing aids resolved. He has trouble hearing the baby at night. But it is ok. My grandkids are great.

Michelle in court.
Looks like there was a love triangle happening. "Sunday Cooley Bennett, 50" was the 'other' woman. She was also killed by Michelle.

Thank God he got the kids. Boo Hoo to her whining, I would have zero sympathy for someone parent like that...hope he gets full perm. custody. Sometimes when grandkids are involved its hard on the grandparents too, my son had 3 when they divorced, the youngest was under 1 year and the oldest was 4...He's home on leave from the Air Force and I had dinner at my daughters with him today...Her girls were home also. Her 2 girls are real close with my grandson. He just got engaged and I met his prospective bride, she is beautiful and seems like a sweet young woman....:O) Things do work out over time....Bless you and your son... Some days a good shot of bourbon helps....

Well, it wasn’t always so bad. She got a prescription for painkillers a couple of years ago and it slowly got a rolling start until it completely mushroomed into full addiction, and she completely went to sh!+. A large part of the problem is her grandmother and mother enabling her. They obviously don’t care enough to get her some help, but they keep handing her money.

And hindsight is 20/20. My son has been beating himself up a lot. But he sees it now for the way it really all was/is. And it isn’t too late for him or the kids to move on. He is 23. She is 21. What the heck do they know anyways at that age? I think there are plenty of people that wake up one day and go look in the mirror and ask themselves your very same question.

exactly. Very sad. As someone who had to many years ago successfully get a restraining order against an ex., I know the situation is often pretty scary that someone has resorted to a restraining order.

It doesn't matter what the hell the gender. If a person needs protection against a whack job, they need protection. Period.
