If SCOTUS says no to the mandate but doesn’t throw out the whole thing he is sitting in the catbird seat.
Without the individual mandate the insurance pools set up the bill will be guaranteed to lose tons of money. No private insurance company would sign up for that.
So would the democrats be happy to see the mandate (first thought up by the Heritage Foundation) found unconstitutional? If private companies won’t play then it will have to be exclusively governments ball game.
I can just see Obama saying, look, we wanted private companies to be partners with us. They refused. We have no CHOICE but to do this ourselves.
So a swing justice could vote no on the mandate, but yes on non-severability, look like a balanced fair arbiter (I voted with conservatives on mandate, against on severability, what could be fairer than that?) but actually be doing the bidding of the socialists in congress.
What would be touted as conservative victory would actually be the final nail in liberty’s coffin.
