Yes, but the backstory is that Micky Dee's started offering free coffee refills, and had deliberately jacked up the coffee temperature to make to too hot to slurp to slow down the drinkers and reduce the number of refills one could drink in a given time period.
That's why they lost, they were deliberately putting out a dangerously scaldingly hot product, a sudden change made without any notice or warning.

Coffee by its very nature is hot. Most places have it upwards of 180 degrees or so as the machines make things that hot.
The woman put the coffee cup, paper cup mind you between her knees an pulled the lid off. Sorry faulty thinking right there ... paper cup, between knees, hot coffee. McDonald’s didn’t tell her to do it that way. She brought on her own problem.
I can see it now ... Surgeon General warings on hot coffee/drinks and hot food over a specific tempreture. say 130 degrees or 150 degrees maybe even 98 degrees.
Sorry, my feelings. Frivilous lawsuit and one of the reasons we have so much trouble these days. The 90’s was a time when we really started becoming a ‘litigeous society’ ... one that loves to sue for anything. That is also a reason tort reform is desperately needed.
Basically one more reason why our society and by extension our country is on a downhill slope. Liberal mentality that everyone must be taken care of by someone else, even for theirown mistakes.
Many fast food joints have a “Mr. X” to check the service and compliance of the franchisees to corporate guidelines. At A&W, he expects the coffee to be at 180* when he sits down with his order.
