Statutory rape victim reportedly forced to pay child support

PHOENIX A man who slept with a 20-year-old woman when he was 14 and didnt learn he was a father until eight years later is now being forced to pay child support, the Arizona Republic reports.
Olivas, who said he was confused and going through a rough patch at that time of his life time, said the two went their separate ways after the encounter.
Arizona law says a child younger than 15 cannot consent to sexual relations with an adult under any circumstance.
All of it was put behind him, he thought, until two years ago he was served papers from the state demanding he pay child support.

I agree with you on that. The DCS departments the social workers, they should all have a Father’s right’s advocate office in them. And they should be staffed equally by heterosexual men and women, not perverts.
Again the presumption of equal custody laws when they are finally passed by all states will help a lot.

I'm pretty sure the 14-year-old girl who was raped, is
not financially responsible for the child she births as the product of rape, as she has the option of putting the child up for adoptionand babies are highly adoptableas well as more vulgar options that are legally available. Though she may (and probably will) take the responsibility upon herself to raise the child, does not mean that she is legally required to do so. As such, how should the 14-year-old boy who was raped be financially responsible for the child his assailant births (through the product of her own illegal action) when he doesn't even have the option of adoption, et al (esp. since, in this case, he didn't even know about, and as I previously mentioned, is legally recognized as being unable to take such responsibilities upon himself.)
I cannot see how the child has a legal father in this case, yes, a biological father, but legally the raped boy cannot be the father. The two are distinct concepts.

Yeah, 14 year-olds say and do all kinds of dumb things. That’s because they’re children.
Except when they murder someone. Then we consider them adults and want them tried as adults.

Furthermore, the law needs to applied equally, there are cases of child support judgments against men who were not the biological fathers of the children they raised, but yet they were accepted as the father of the children. Similarly, what do you do in the case of a sperm-donor operating through a sperm-bank whose sperm sires a child, he is the biological father, should he be financially responsible for his child?

That’s because at a certain age, children should be expected to know that murder has dire consequences, and that certain assaults will likely result in death. Young children simply do not grasp the concept of the permanence of death, therefore you won’t see a 4-year-old on trial even if it can be proven the child intended specifically to murder, not so for a 14-year-old murderer.

It was statuatory rape, but unless she forced him, it was still his decision, even if he was only 14. You seem to be unclear on the concept of statutory rape.
