Wal-Mart says actor-comedian Tracy Morgan and other people in a vehicle struck from behind by a company truck on a New Jersey highway in June weren't wearing seatbelts.

Limousenes are exempt from seatbelt laws.

And of course there are the rural mail carriers who drive from the passenger seat so the mailbox is at their window of the vehicle to insert the mail at each home. No problems there either?

Everyone should be exempt from seatbelt laws except for minors. If we can ride a motorcycle with no helmet then why do we require drivers to wear seatbelts?

Allow insurance companies to have a clause in the policy that states “if you are injured in an accident and were NOT wearing a seatbelt you are only covered up to $XX amount.”

Personal responsibility!

My insurance company did that as the seatbelt laws were just getting started. It got me to do it.

NJ seat belt law is front seat only, plus people under the age of 18. There are a few exceptions, etc, but that roughly covers the legal requirement.

Maybe. I don't know the law there. All I know is they were having a rolling party. I would bet dollars to doughnut holes they were not wearing seat belts.

Walmart should not try to make excuses on this one. Just pay the man and move on.

Found this at the New Jersey government site: "New Jersey’s Seat Belt Law: (NJS 39:3-76.2f)

Applies to all passenger vehicles including vans, pickup trucks and SUV's, that are required to be equipped with seat belts. Applies to all passengers, who are at least 8 years of age but less than 18 years of age, and each driver and front seat passenger of a passenger automobile, operated on a street or highway. All of these occupants are required to wear a properly adjusted and fastened seat belt system.

On January 18, 2010, legislation was signed into law requiring all occupants to buckle up, regardless of their seating position in a vehicle. A secondary offense, the new law allows police to issue summonses to unbuckled back seat occupants, 18 years of age and older, when the vehicle they are riding in is stopped for another violation. The law is effective immediately."

One limo site I checked said that wearing seatbelts is mandatory for all occupants as required by their insurance company.

The last thing the lawyers of the Left would permit is a return to the days when personal responsibility was expected. They would go broke in short order. How would they get a third of an award if a person of average intellect looked both ways when crossing a street?

Tort attorneys need to contribute in some positive way to society. I guess if they’re unwilling to learn an honest trade, we always need firewood.

Whether or not they were wearing seatbelts does not mean Wal-Mart trucks can hit them.

What does this have to do with anything? THE DRIVER FELL ASLEEP. Sometimes it’s better you don’t have a seatbelt on. I am surprised WALMART released this.
