A question concerning state's power.

Posted on 08/23/2015 8:55:06 AM PDT by LouAvul

An Arizona sheriff took Dr. Carson for a helicopter ride to point out large areas controlled by armed illegals who smuggle drugs. My question is, why does the governor not mobilize armed personnel to take back the state?

It's hard to believe that the law enforcement of the state is content to just let them (crimigrants) stay there.

I guess it’s because immigration is a federal issue. At least that’s what Obama says. And the states are afraid to cross the feds.

States can use force to defend against invasion. A State and Congress are the only authorities to enter into War.

Regardless of whether or not immigration is a federal issue, the state and the counties have a duty to uphold/enforce all laws and private property rights. If necessary, they should hire a mercenary army to get these people off of private lands. The right to the use and control of one’s private property used to be inviolate, and trespassing was not allowed.

States can use force to defend against invasion

States use force to combat the illegal drug trade. The governor has the state police at his disposal to this end. The governor of Arizona could order SWAT units of the state police to eliminate the wetback threat in those areas.

That's why I'm skeptical that the situation exists. I find it very hard to believe armies of drug smuggling armed wetbacks have commandeered such huge sections of Arizona.

I agree. But the question is “why don’t they?”.

Could it be that this is on federal property?

The Current Occupant now squatting in the White, er, “Rainbow” Hut, has already come down on Arizona for daring to try to enforce the border, by passing a law almost identical to the Federal statute, as regards border crossing.

Citing Congress’ failure to enforce U.S. immigration laws, the state of Arizona confronted reform and on April 23, 2010 Republican Governor Jan Brewer signed the Support Our Law Enforcement and Safe Neighborhoods Act (Arizona SB 1070), the broadest and strictest immigration reform imposed in the United States.

The SB1070 Arizona immigration law directs law enforcement officials to ask for immigration papers on a “reasonable suspicion” that a person might be an illegal immigrant and make arrests for not carrying ID papers in keeping with federal requirements. Previously, police could not stop and check identification papers on a mere suspicion that someone might be an illegal immigrant. Police could only ask about an individual’s immigration status if they are suspected of involvement in another crime.

On July 6, 2010, the US Department of Justice filed suit against Arizona. The intent of the suit is to prevent Arizona from enforcing the law and asks the court to find certain sections of the legislation null and void.

State officials used to take an oath to uphold and defend the US Constitution as well as their state’s constitution. I’m not sure if that is still true everywhere. Probably not.

What state powers...?....I think, don’t know, that a state MAY be able to use the National Guard to inspect an area such as this as a Civil Hazard. I ain’t a lawyer.

It seems it was not revealed until recently.

DHS Kept Secret the Release Of Violent Criminal Illegal Immigrants
Local law enforcement ‘perplexed’ over controversial policy

In the video below -
The 3 criminals are from different countries: Sudan, Iraq, and Russia, not Mexico.
Convicted of crimes, and released into community.
If Americans were convicted we would have to serve 85% of sentence, these illegals only have to serve 50%.
The excuse ICE is using is that there are no legitimate travel documents, because they are here illegally.

Article IV Section 4. - The United States shall guarantee to every state in the Union a republican form of government, and shall protect each of them against invasion . . .

By this section, border defense isn't optional.

It is a requirement of the United States, but instead the United States sponsors and funds the invasion! This isn't government, it is tyranny; it is done for the benefit of a small ruling class at the expense of the general welfare.

The area where the helicopter flew and where the illegal activity occcurs begins by crossing a little wooden barrier from Sonora Mexico into a national forest in which stands a monument to a Border Patrol agent killed there. The forest abuts remote stretches of land and one trail goes across an Indian reservation.the desert.

What is described is accurate.

I know BP agents who describe it as reported.

They’ll tell you that it’s “out of their hands” or “it falls under federal jurisdiction” or “they don’t have the authority or resources” or some other BS excuse.

Why don’t these useless POS law enforcement agencies just come right out and tell Americans that they work for the Washington DC - Mexican cartels, and be done with it. They get PAID to just stand by and let hordes of illegals rush over our border in a non-stop south american invasion.

And then the assholes in government and law enforcement will give YOU shit, and arrest you if you say or do anything about it.

The next American - mexican war will be fought on US soil, but this time around, the US government will side with the mexicans.

Believe me, it’s coming, and the invasion has already started.

Apparently you have forgotten the uproar over AZ Senate bill 1070. That is the one that said Arizona law enforcement officials Would enforce Federal statutes as well as Arizona. The left, the right, Democrats, Republicans, Mexico and many South American countries all said we were a racist state and tried to boycott us..
Courts even ruled that we were racist.
Paul Babeu is the sheriff of Pinal County who gave Dr. Carson the tour. A county 60 miles from the border. He has an anti-smuggling unit working full time on smuggling both human & drugs and the entire K9 unit that is devoted to drug interdiction on the highways, especially I-8 and I-10. This in addition to the normal law enforcement duties of a sheriff’s dept. in a county the size of some states. I for one do not know what more he could do.
