Actually, I haven't heard of eminent domain being used 'round here for pipeline ROWs. Most folks jump at a deal which pays them big bucks for letting petrofolks use a narrow strip of their land -- while also paying them handsomely for the timber harvested to clear it.

And as I said, they still have surface use and mineral rights to extract oil/gas from beneath the ROW (which the pipeline folks keep nicely mowed -- and which also makes a great firebreak...)

Heck, we even use the ROW across our place as a site for birthday parties, etc...

Besides in Texas, any private pipeline concern who tried using ED on Texas landowners just might find themselves a test case for the theory that .50 BMG antimateriel rounds work wonders on the blocks of diesel engines...
