It is awful watching the news media objectify Cliven Bundy and there is no easy corrective to the situation. It may help, however, to know a little more about Bundyâs history and what he means when he says that his family has ranched in the area since the late nineteenth century.

Quick and easy question:
What land does his family actually own?
Not lease, not let.. but own?
I read the article. I thinks it’s 160 acres, not sure. He does own the water rights on the public land, however. I didn’t know that was possible. As I said, I’m not a supporter. In fact, I don’t care for him at all. But like I also said, more info is better.
There is another question to ask if the feds claim to own the land.
More specifically, if the feds claim to own the land, then did the feds purchase the land on the basis of either the Constitutions Clause 17 of Section 8 of Article I, or the 5th Amendments eminent domain clause?
Otherwise, if the feds negotiated control of the land when Nevada became a state, then there questions on the constitutionality of such a practice.
Most lands in the far west are owned under Article IV, section 3, clause 2.
I don't recall the citation currently, but I believe the Supreme Court held back in the 1970s that the Article I, sec. 8 provisions apply if the federal government is taking property in a place that is already a state, but that Article 4 applies if the federal government owned land in a territory before that territory became a state.

So the question of federal governments possible purchase of land in Nevada before it became a state needs to be addressed.
A good question is who did Congress purchase land that became Nevada from? Spain came to mind but Spain lost land in Spanish American War I believe.

My take away from that article.... Bundy got tired of trying to hit the government’s moving target. And that moving target kept cutting him back from what he wanted to do.
None of the legal arguments matter. thank you for posting this but we have come to a time when might makes right and the Feds have all the might. They could tie people up for decades in any legal challenge, using taxpayer money. they could, have, and will bankrupt people.
These big agencies have no watchdog. The media is entirely on their side in that they don’t look into corruption. This goes for the BLM, and EPA, VA and IRS and God knows how many others. They have no watchdogs.
They can be as corrupt as they please and get away with it.

I noticed this in the twitter and Daily Mail comments page during thee siege. All the mean and negative comments were those of social snobbery. Here’s a few:

Some of these were trolls but it is telling that the insults are those of class snobbery.

The Mexican American war was 1846-47. Mexico ceded those lands to created the US southwest(including Nevada). The Gadsden Purchase was 1853
The Spanish American war was in 1898. Remember Teddy and the Rough Riders charging up San Juan Hill in Cuba. Spain lost the last of her new world holdings: Cuba, Puerto Rico and the Philippines.
Nevada became a territory in 1861 and a state in 1864
