Teen Charged With Second-Degree Murder for Allegedly Killing Man Who Attacked His Mom
KFOR ^ | MARCH 9, 2016 | K. QUERRY

A 15-year-old boy is facing a second-degree murder charge for killing a man he says was attacking his mother.

Authorities told WTVR that 37-year-old John Conroy, Jr. was dating the boy's mother when the pair got into an argument.

"Detectives determined that the incident began several hours earlier, when Conroy and his 36-year-old girlfriend, who is also a resident in the home, began arguing. At some point, according to initial information garnered by detectives, Conroy began physically attacking her, in the presence of her juvenile son, who is not related to Conroy," Spotsylvania Sheriff’s spokesman Capt. Jeff Pearce said. "The woman's son, attempting to intervene, took a semiautomatic firearm from a nearby location in the room and fired several shots at Conroy, striking him multiple times."

The boy's mother was treated for non-life threatening injuries.

The teenager was arrested and charged with second-degree murder and use of a firearm during the commission of a felony.

So...it's a felony to protect your mother from a physical assault?

If this story is accurate, and the boy shot a man who was physically beating his mother...I believe the jury will find in the boy's favor.

Even money that the mother will side with the abusive boyfriend against her son.

Well, if the boyfriend had lived, it would be almost sure money. But with him dead, perhaps she can find someone else for the role and there is some possibility that she might testify for her son.

Similar situation occurred years ago when a teenager shot an abusive stepfather who was assaulting his mother. Charge was reduced to manslaughter, then dropped completely before trial. Expect the same to happen here unless there are circumstances hat warrant prosecution.

I hope you are right.
If the facts are as presented, I would acquit.

Summary of Virginia Firearms Laws

Looks like Virginia is one of those s***holes that requires a "proportional response" so yes it is a felony to defend your mother with a gun if she is "only" being beaten up.

All he has to show, IMHO, is that he feared...and she feared...that she would die.

If that can be established, it would seem to me that a proportional response to THAT, would be to use deadly force against the attacker.

Based on the limited information available, at this point I’d rather defend than prosecute. Kind of depends on the decedent and the shooter as to which way it might go with the jury. Mama could probably really hurt or help her son depending on what she wants to do.

Case is unlikely to be decided on the merits of what actually happened in the room.

bleepin bureaucrats.

why not something generic like manslaughter anyhow, until it is gone to a grand jury. sounds more like someone is trying to “send a message” about “gun crime” — what if the lad had stabbed the assailant with a knife?

well really all that is needed is that the lad feared it. he can’t read her mind.

Even though “beating” in a certain manner can instantly kill... and you betcha too that these aren’t rules binding on the fuzz either.

Spotsylvania is near Fredericksburg, Va., about 50 miles south of DC. Don't know if the area has turned "blue," as has everything to the north, but when I stayed there in 1981, my motel was located on Jefferson Davis Highway and I saw a Bonnie Blue Flag flying over one residence.

Perhaps the case will be tried in the Spotsylvania Courthouse, which is next to the famous battlefield of the same name.

If this kid doesn’t take action and his mom becomes another statistic, then we would being hearing for a couple news cycles about tragedy of domestic violence in today’s society.
