Woman 'Distraught' Over Hospital Staff's Recorded Remarks During Her Surgery

A Texas woman says she remains "distraught" by comments she secretly recorded hospital staff making about her attitude as well as her weight as they worked on her unconscious body during a 2015 operation.
"I can't even express how I feel," Ethel Easter told ABC News today.
"He started abruptly yelling at me, saying, 'Who do you think you are?'" Easter said.
Easter said she started crying and was later informed by a different doctor during another visit that the surgeon had left "bad notes" in her file. Easter said at that point, a "red flag" went up. She said she didn't want to cancel or reschedule the surgery for later, though.
"That's when I decided to record it," Easter said. "I just decided to hide [the audio-recording device] in my hair."

Yeah, the OR staff had no call to insult her and stuff. But they did have a reasonable expectation of privacy.

At one point during surgery, a nurse’s voice said ‘Have you seen her Bellybutton?”, the question was followed by loud laughter. No photos were provided of her “funny-button”.

On the recording, a hospital staff member could be heard saying, "Precious, yes. This is Precious over here, saying hi to Precious over there." . . . She was an obese African-American woman who was raped by her father. ... "I was distraught," she said. Looking at her picture, I don't know if Precious is fair. Maybe Esther Rolle, but not Precious.

But they did have a reasonable expectation of privacy.Wouldn't matter, unfortunately. Tejas is a "one party consent" state - so long as one party knows the recording is taking place, no consent is needed on the part of the 2nd party.

True. But it used to be the case (unless I am romanticizing years past) that the patient had a reasonable expectation of decency and respect from the medical professionals in which she was placing trust.
These days, decency, professionalism and a respect for another human being are increasingly rare commodities, it seems.

I’m with you. The patient’s dignity should be respected no matter what. It’s scary enough to go under anesthesia, etc. without worrying about them making fun of you while you’re helpless and vulnerable.

I don’t know what “damages” there are since she seems fine medically, but the staff was obnoxious. I wouldn’t want my life in their hands.
Sadly, there are too many jackholes and perverts in the medical field as any field, however, medical should have much higher standards.
