There is an effective method for putting pressure on sanctuary cities and states to rethink their current positions. Congress can enact a law that eliminates states' and cities' 11th amendment immunity rights. This would allow victims and their families to sue cities and states and elecr d officials acting in their officia capacities for wrongful death and other causes of action for damages arising out of sanctuary city policies. Take away their immunity, and their hearts will soon follow!
I may be wrong and you may be right.
Sorry charlie. That is why it is called “sovereign” immunity. The “sovereign” is the state. Its in the state’s constitution. It can and is waived by the state but not by Congress.
Your wrong. Congress can conditi. The acceptance of federal funds by states on the waiver of sovereign immunity. States don’t have to take the money. It’s voluntary. He who pays the piper calls the tune. Lots of case law on this!
Good legal minds here.
If the county collects taxes for the designated sanctuary cities and schools (who designate themselves) as sanctuaries, can one consider a class action law suit to be refunded those dollars that went for illegal residents, and the cost to educate them, or provide financial services to them?
Of our property taxes, about $1800 a year goes to the city school district. Good chunk of that has probably gone for people who are not even legally in the country.
Better use of that money would be to help our veterans!
You are right, but please, for purposes of legal discussions, pretty please, let’s all pretend Louisiana does not exist. It’s law is not based on British Common Law, but rather French and Spanish law, and whatever the Levy Board thinks it should be.
:)
In “Trade School” (Law School) we were all told: “Never have anything to do with law in Louisiana. Never take a case that has anything to do with Louisiana or any possible venue there.
Louisianians are great people, but for legal purposes, pretend there is a great blank area on the map east of Texas and west of Mississippi. Pretend the blank space simply says “Enter Nor Dawdle Not - Demons Dwell Here”
Thanks for the info
Cite a case that says that the federal government has lifted the waiver of state sovereign immunity.

The 11th amendment is part of the Constitution. Congress cannot change it by passing a law.

I fail to come up w/ more than 1 or 2 Amendments where this is NOT done.
Only if they can use the Law for THEIR benefit do they care about the Constitution and Rights.
