“On this issue, on immigration, I feel like we have a story to tell. I feel like we have something to say that is different and unique and special to Hawaii,” said Chin, adding other states’ arguments focus solely on the adverse economic impact of the order. “To me, there’s so much that is deeper than that. It’s not just the money. It’s not just the tourism dollars or the college education dollars. It’s the assault on our culture. It’s the assault on just kind of the values that Hawaii really stands for.”

Send all those ‘refugees’ from Australia to Hawaii since they want them so badly.

Can’t wait to see how the jihadis react to all the barely-clothed hula girls.

The very definition of an Attorney General-- whether elected or appointed-- is the lawyer for the State and its citizens "generally", as opposed to private lawyers who represent only the clients who retained them. So he is not misspeaking.

Is a Class Action Suit possible ? Atty's , please advise

On what grounds? With rare exceptions, public officials may not be sued for their official acts.

If the people of Hawai'i are not happy with the job the AG is doing, they can vote against the Governor who appointed him.

“Commandeering is coercion on the part of the federal government to exert undue influence over policies districts see as their own purview by threatening to withhold funding.”

They are going to use “commandeering” as a legal excuse if funds are withheld.

Uh,huh !

When did immigration become part of the purview of the state of Hawaii?????????

Repeat after me: "It is NOT a 'TRAVEL BAN' order. It is an ‘ INVASION BAN’ order."

This issue is not "travel". The issue is invasion. It is a constitutional ban on invasion.

"The United States...shall protect each [state] against invasion" (Art IV, Sec 4, U.S. Constitution).

Illegal immigration and immigration of our enemies is INVASION which the Constitution specifically mandates the federal government to prevent.

Don't repeat the Lying Leftists Labels. This and related articles should be posted as an Invasion Ban Order.

Wait just a minute. Native Hawaiians get, or used to get all pizzy about foreigners buying up their land so why would they be happy about bringing in more foreigners. Hawaii has a big welfare problem which will only be increased with muzzies.

Shut down US Customs and Immigration at all Hawaiian airports for a couple of weeks, and see what he’s saying then.

"Commandeering" is a legal term which comes from Justice Scalia's decision for the U.S. Supreme Court in Printz v. United States (1997). The Brady Bill, which required background checks on handgun sales, originally required local sheriffs to conduct the checks. The Supreme Court held that Congress cannot "commandeer" states to enforce federal law; if the feds wanted background checks, the federal government had to do them itself.

In the immigration context, this means that states cannot obstruct federal immigration law-- if ICE shows up with a warrant for an illegal alien in state custody, the state can't refuse to turn him over-- but the federal government can't force states to arrest illegals or to hold them in state jails at the state's expense.

Thanks for that explanation.

What I still don’t get is how a state can have any say in who is allowed,or not allowed, into the country.

Now that we finally have a majority in the USSC that will overturn the circus judges that have been holding the travel ban hostage, our president will soon have the green light to go full throttle with it.

They don't-- or shouldn't, and I expect the rulings against Trump's immigration EOs will be overturned by SCOTUS.

But the federal government cannot force states, at their own expense, to enforce federal law. So some of what "sanctuary cities" are doing is illegal, but much of it (while stupid) is probably not illegal.

For example, California recently voted to use state funds to hire lawyers to represent illegal aliens in immigration court. A stupid way to spend the state's money, IMO, but not illegal under federal law, and not grounds for defunding California. But if California were to refuse to turn over illegals in state custody if ICE shows up with a warrant, that would be illegal-- criminal, in fact.
