Canada's beer smuggler is our new national hero

Caught in a sting and handed a nearly $300 ticket for smuggling contraband, Mr. Comeau demanded his day in court. He argued that the prohibition against transporting booze across provincial lines violated Section 121 of Canada's Constitution Act, 1867, which on any plain reading promises free trade of goods between the provinces. And, miracle of miracles, he won. And having won in Provincial Court, and with the Court Of Appeal punting it upstairs, he's been dragged to the Supreme Court of Canada to argue his case.

And his case, in a nutshell, is pretty compelling. As he put it in the legalese of the common man after his victory in 2016:

"The way I look at it, I'm a Canadian citizen. I don't see any reason why I can't go buy merchandise anywhere in this country and bring it home. You can buy anything else like cars, clothes, everything. Except for beer."

Unlike Canada, the 21st Amendment gives the states exclusive jurisdiction over alcohol sales in the US.

It’s all about tax money. Canadian provinces put massive taxes on booze, sold through government stores that also artificially inflate the prices. Quebec is the most socialist province in Canada except for beer and wine, which can be sold in private stores. You can get a 24 case of Budweiser in Quebec for $25. Before the court ruling the government stores in NEw Brunswick province sold the same case for $43. They dropped the price this summer to $36 per case. NBers living closer to the Quebec border frequently go across for beer. People in Nova Scotia frequently go to NB for high end Scotch, Bourbon, Cognac as NS prices are even worse than NB. And starting in July 2018 these same government monopoly liquor stores will be selling marijuana.

Superb article. Thanks for posting. It’s so well written (especially the concluding paragraphs) that I recommend reading it all the way through, even for those who are not interested in the headline topic.

Yes. One of my favorite movies. For one of my son’s talent shows I thought it would be fun to have him and one of his buddies do the MacKenzie brothers, but he was too shy.
