Why this man who barged in on his cheating wife could go to jail for 15 years

Sean Donis’s wife, Nancy Donis, 38, said she was going to dinner. Donis stayed behind to watch their 5-year-old son. When he couldn’t find his iPad, he turned on the Find My iPhone app to locate it.

The software showed the electronic device moving toward an unknown location; he had a hunch that his wife had taken it, and he decided to follow. He arrived at a house and opened the unlocked door. On the second floor, he found his wife in bed with her boss, Albert Lopez, 58. With his iPhone, he recorded two brief videos of them in bed.

The New Jersey man got a letter last July informing him that a grand jury had indicted him on charges of felony burglary and unlawful surveillance for the April 2016 incident.

Donis’s wife worked for Lopez as the billing manager for his orthopedics practice.

Lopez said he was so desperate to get the enraged husband out of his home that he asked Donis “if he wanted to die.”

“Kill me. I don’t care,” he said the desperate husband responded.

Lopez also noted that Donis’s wife said they were separated, and he thought Donis was out of the picture.

The husband’s lawyer, Howard Greenberg, told jurors that the husband actually “deserves a medal,” not a prison sentence, for uncovering his wife’s unfaithfulness without physically harming his rival.

However, despite the fact that Lopez slept with Donis’s wife, prosecutor Nabeela Mcleod asserted that Lopez was a victim — a victim of Donis’s breaking and entering his home and recording him and Donis’s wife without their consent (Donis shared the videos with his wife’s relatives). He now faces a possible maximum sentence of 15 years in prison.

Agreed. But I think the appropriate charge would have been criminal trespass not burglary.

That’s a default setting for Apple devices. Very handy when a device is misplaced. I use it several times per year (as a developer & aficionado, I have ~11 such devices). Nothing “suspicious” about enabling tracking, and people tend to keep such personal devices handy at all times.

And yeah, maybe he did deliberately wonder about her location. So what? apparently his suspicions proved correct, and he has a right to know she’s cheating.

I’d go so far as suggest that since she vowed (directly or implicitly) to remain monogamous to him, he could construe the act as suspicion & discovery of statutory rape.

People have gotten out of going to prison for killing them both in that situation.

Finding your wife in bed with another man?

Put me on the jury - I won’t vote to convict.

Yep. It’s definitely a trait among some women. They hit their mid 30’s and are done having kids. So they look to upgrade the husband if current hubby’s career/financial status isn’t up to their requirements. Looks like this lady lied to her boss to try and get her boss.

Agreed.
CULTURE, not color.

While the two correlate, they’re not causal.
We need to get away from, and make clear we’re staying away from, anything that can be construed as actual “racism”. We don’t care what someone’s skin color is, we care what their behavior is. There’s plenty of “white trash” making the same bad choices as “she” did, and plenty of upstanding laudable POCs who don’t deserve to be smeared by the actions of strangers.

In this day and age the husband is lucky he wasn't shot by his wife's lover.

Yes in the good old days were women were considered a husbands property, this guy did the “right thing.”

In today's Femi-Nazi culture of emasculated men, the guy will likely face serious prison time for breaking and entering, filming without consent and other charges.

The cruel fact of modern life is if a wife wants to cheat on her husband, she can and the safest & most legal thing a husband can do is call an attorney and divorce her.

Imagine the charges if the husband had struck the other man or worse (?) yet grabbed his wife and physically dragged her back home against her will? I am sure the charges of spousal abuse would have been the headlines.

It is a sad state of affairs the way today's laws are enforced.

I’m from NJ originally, but moved to Texas 18 years ago.

In NJ, you get charged with a crime for uncovering an unfaithful spouse.

In Texas, you can shoot the bastard screwing your wife.

NJ just keeps validating my decision to move. Thanks, yoooz guys.

I’m sure I won’t convince you or NEMDF but unless you have had this happen to you you cannot even begin to imagine the rage you feel. Some of us manage to control ourselves, some don’t.

2nd point: The guy having sex with Lopez’s wife should not get off scot free (he should be charged with some criminal law).

3rd point: Right or wrong, I believe millions of US men feel that Lopez should have been legally justified to shoot him.

4th point: Like her lover, the woman should be charged with a CRIME equal to the husband. I personally feel that “intentional destruction of a family unit” should be a serious crime. I feel this when I look at him with his boys.
His wife “intentionally” blew up that family unit and inflicted life time damage on those kids! Ergo, she should not be allowed to get off scot free.
