As sad as it may be, he had a warrant for murder and was running from the cops, this is not a saint in my book.
You brandish a weapon when being chased by a police officer and you definitely will be a target. They told him to drop the gun and he continues to attempt an escape and then brandishes the weapon again. Seems to me like he was wanting to die.

What is the officer supposed to do? Wait until the officer is shot or dead or an innocent bystander is shot?

Looks like a good shoot to me. I’d like to see the autopsy report to see what the grouping on target was but aside from that it’s all good.
Most people, law enforcement and otherwise, will shoot you if you try to point a gun at them.
