Justice Department rebuked for delay tactics in Biden-Hur tapes pursuant to judge's order

The Justice Department faced criticism on Friday for pushing back on a federal court's order to expedite the timeline for determining whether recordings of President Biden's interviews with then-Special Counsel Robert Hur should be released.

The situation developed after advocacy groups filed a Freedom of Information Act (FOIA) request for the recording last month.

The Heritage Foundation's Oversight Project, as well as Judicial Watch and CNN, all filed requests seeking the release of the tapes, which congressional Republicans have sought and unsuccessfully subpoenaed. The three organizations' FOIA requests were combined into one suit.

In April, the DOJ announced it would not abide by a subpoena from House Republicans, while maintaining its cooperation with Congress' Biden family investigation has been "extraordinary." That development led Reps. James Comer, R-Ky., and Jim Jordan, R-Ohio, to threaten Attorney General Merrick Garland with a contempt of Congress citation.

However, Washington, D.C.'s U.S. District Court ruled this week there would be an expedited briefing schedule to litigate the release of the tapes, which Republicans claim will further prove Biden's cognitive decline and lack of fitness for office.

Kyle Brosnan, an attorney and chief counsel for the Oversight Project, called the Justice Department's arguments for what he said was originally roughly an August briefing schedule "absurd," telling Fox News Digital on Friday that it is in the public interest to have the tapes released promptly.

While the Oversight Project, Judicial Watch and CNN had their FOIA suits merged, Brosnan said each plaintiff can continue to independently file its own briefs and motions.

Brosnan also noted how Jordan and Comer's panels have subpoenaed the same recordings and threatened Garland with contempt, saying that shows the lawsuit has been briefed to the top levels of the Justice Department already.

When you work for Joe Biden, laws really are for the little people — even when you’re in charge of enforcing them. Witness Black Justice Department civil rights chief Kristen Clarke, who’s admitted that she lied during her 2021 Senate confirmation process.

Asked by Sen. Tom Cotton (R-Ark.) if she had “ever been arrested for or accused of committing a violent crime against any person,” Clarke answered no. In fact, she had been — on a 2006 domestic violence complaint when she allegedly sliced open her hubby’s finger with a knife.

Clarke’s now arguing that because the arrest was expunged, she wasn’t required to disclose it to lawmakers. That’s precisely the kind of razor-sharp logic that top Biden appointees are known for.

Then again, Clarke’s the same dunderhead who muffed a major question about First Amendment litigation last year, claiming in a congressional hearing to be totally unaware of the lawsuit by the state of Missouri against the president over government efforts against “disinformation” — a huge civil rights issue where Team Biden had lost and was appealing to the Supreme Court. Her defense now is beyond pathetic.

Black DOJ official Kristen Clarke reluctantly comes clean after falsely testifying to Senate that she had never been arrested. She told an unambiguous lie to Congress. Was she thinking she’d never get caught, or that if she did, her political connections would protect her? It’s of a piece with the overall attitude of Biden’s circle: If you have the power, laws don’t apply to you.

That a scofflaw like this should serve at such a high level in the Justice Department is beyond absurd. How can someone who seemingly lies under oath be trusted with seeing that laws are properly enforced and justice is truly served? Not that Clarke’s previous record was stellar.

She lobbied the Obama administration, way back in 2009, to let Black Panthers who terrorized black poll workers off the hook. She served on an academic journal with antisemitic 9/11 truther Amiri Baraka, and lied about that too. In other words, she’s a radical to the bone.


But that’s a plus in this administration: Biden has remade Justice into the enforcement arm of his political agenda, siccing the FBI on (for example) parents who protest school boards. To Bidumb, ideology is what matters, not integrity.

Arrest Garland and put him in jail for contempt. Steve Bannon lost his appeal on contempt and is now headed for jail.

Our party never puts these folks in jail who refuse to show or give documents requested.
