Smoking ban raises problems for nursing homes

Delaware County's ban on smoking in most work places has become a problem for some nursing homes, which are both work places for employees and homes for the residents.

The smoking ordinance does not prevent people from smoking in their homes, but it does ban smoking in most public buildings and work spaces.

If a nursing home bans smoking, they could lose federal funding for failing to comply with regulations, but if they allow smoking they could face fines or a lawsuit from the county health department, officials said.

Federal regulations state that if a nursing home changes its policy and bans smoking, it must create an appropriate area for current residents to continue smoking.

Robin Shackleford, a policy and research specialist for the Indiana Health Care Association, said nursing homes could jeopardize their Medicaid and Medicare funding if they follow the county's ban.

"This is not a health issue - it's a patients' rights issue," Shackleford said. "The facilities are caught in the middle of deciding which law to comply with."

To fix the problem, Delaware County commissioners have introduced an ordinance to exempt nursing homes from the smoking ban. But two of the three commissioners say they don't plan to approve the exemption when final action is taken on Oct. 2.

Commissioner Larry Crouch said smoking should not be allowed in nursing homes.

"How many people are in these nursing homes because of a smoking habit?" Crouch asked.

Great post!! I work in two nursing homes. Out of the 150 residents that I work with only 9 are smokers. We take them outside to smoke only as time allows. I beleive that at 80+ years of age they should be allowed to enjoy life pretty much as they see fit. I also think that diabetics should be allowed sweets if they so choose what the H*ll is it gonna hurt. Not that the home allows the diabetics to have sweets I just think they should. We have happy hour once a week where residents can consume alcohol. We also have residents who have a beer or glass of wine everyday. These people have seen enough heartache in their lives why not let live out their last years smoking if they want?
Side note....NO ONE is allowed to smoke with their oxygen on...EVER!!!!!!!!!!!

No one is stopping or suggesting that you or others not speak your mind. However, exhaling smoke is not a protected free speech right.

I have no interest in debating this idiocy there is nothing on the otherside worth listening to. It is like debating someone about the right to own slaves.

You have no more "right" to smoke cigarettes than you do to smoke marijuana. And smoking is nothing conservatives advocate.

My mother always said if I can't say something nice about someone, don't say anything at all.

I pass a nursing home every day. In the winter is see those poor old, frail people out in the cold, rain and snow smoking. How they don't die of pneumonia I don't know.

You posted 29 specific instances. From the orientation of the sources, I'd say that was all, because if there were more they would have been listed.

How many nursing care facilities are there in the US. How many residents thereof are there in the US? Divide 29 by that number to get a percentage, and probably get a number in E notation.

Then tell us again why it's a big deal.

Not too surprising that the cost of using the gum is roughly equivalent to that of smoking. If they really wanted people to quit they'd sell it cheap.
