Navy SEAL Author Rejects the Pentagon's Legal Threat

Defense Department's top attorney , "all remedies legally available" against the publication of No Easy Day, (of the) firsthand account of the mission (which culminated in the demise of 0 bin Laden).

"You are in material breach and violation of the nondisclosure agreements you signed," wrote Pentagon general counsel Jeh Charles Johnson. The letter; threats of a criminal prosecution seizure of as well as go after publisher Dutton, an imprint of Penguin Group.

In a written response, "Mr. Owen sought legal advice about his responsibilities before agreeing to publish his book and scrupulously reviewed the work to ensure that it did not disclose any material that would put his former comrades at risk," wrote Robert D. Luskin, an attorney at D.C. Patton Boggs. "Mr. Owen is proud of his service and respectful of his obligations.

The Pentagon said that because the author is a retired service member, any potential criminal prosecution would be handled by the Department of Justice.

A few editorials to some major newspapers regarding investigating obama’s leaks would be a good thing. After all, when the COMMANDER IN CHIEF LEAKS INFORMATION he absolutely betrays his oath of office.

I Don't think he's in any trouble. I do think the Pentagon is being pushed to do it, and cooperating because they know there is nothing that would damage national security.

The only damage is to personal security, the risk is to the holders of office who violated laws, treaties, lied to the public.

AND THAT is what 'they' wish to stop most. They LIED and continue to LIE to the public.

I think that's what this is about. Obama ordered the Pentagon and CIA to cooperate in Kathryn Bigelow’s movie. If this new book becomes a movie it could be released before Bigelow’s movie which is the “official version.” Harvey Weinstein is already making something called “Code Name Geronimo” that is supposed to beat Bigelow’s picture to the theaters.

While we are talking about made up stuff...

The whole ‘government’ version is that they wrapped Bin Laden in ‘something’ and threw him over the side while out at sea, in respect of the Islamic customs.

Anyone ever hear of an Islamic Burial at Sea ? That they would have preferred that over having the body returned to his homeland ? Does any of that make sense ?

If the Justice Department decides to prosecute this guy a trial will open up the whole can of worms—the Stuxnet Virus, drone target hit list, Bin Laden raid, etc.—of secrets leaked by the White House. Subpoenas delivered to the National Security Council would probably get the government to drop the case.

I read a law many years ago, it was to the affect that a contract or agreement did not change the law.

It doesn’t matter what else has been leaked or by whom. If this guy told anything that was covered by the non-disclosure agreement, then he committed a crime and can be prosecuted for it.

That’s the legal reality. I am expressing no opinion for or against the guy.

0bama’s goal...diminish. the US Military. I’ve never seen such divisiveness in the US Armed forces as I have under his term. This is what happens when the troops have no faith that their CIC has their back or believes in their mission.

That's all irrelevant. Legally, the president has full classification and declassification authority; he can declassify whatever information he wishes to whenever he wishes to.

A Navy SEAL does not have declassification authority.

A President can simply say anything he wants publicly about US covert operations (operations that could and probably have put American operatives’ lives in jeopardy) and NOTHING can be done? His oath when he took office to protect and defend the United States of America has no real binding authority? The president can MURDER at will when it comes to our military? Is this true?
