Berg Files New Eligibility-Related Action in District Court in D.C.

Philadelphia attorney Philip Berg filed a new lawsuit today in the United States District Court for the District of Columbia, once again suggesting that the currently vacationing Barack Obama is constitutionally ineligible to serve as president of the United States, and once again hoping to compel disclosure of any personal information relevant to the question.

He also filed a motion in which he asked the court to compel the defendants, in this case both Obama and Joseph Biden, to respond to the complaint within ten days, putting the proposed deadline at January 8, 2009, the same day the Electoral College votes are to be counted.

Berg's first suit, filed in district court in Philadelphia on August 21, 2008 and broken here at America's Right, alleged that because Obama was likely born in Kenya rather than Hawaii as he contends, and because he was likely adopted by his Indonesian stepfather and never regained U.S. citizenship, his presidency would be invalid pursuant to Article II, Section 1 of the U.S. Constitution which holds that only "natural born" citizens can hold the office of the president. Facets of that first action will be discussed in a pair of conferences at the United States Supreme Court on January 9 and January 16, 2009. This new suit, Hollister v. Soetoro, is part of what Berg calls a "concerted effort to find a legal avenue to expose the truth about Barack Obama, joins his original action as well as a related suit filed under seal under the False Claims Act, and is markedly different from anything Berg has filed before.

I agree that Obama has NOT proven he is eligible to be seated as the next president but I think other ways will needed to prevent him from taking office. The court is not going to hear this suit from Berg, they think(know) he is a nutcase.

I urge Freepers to immediately contact their representatives urging them to take this issue seriously and to act quickly. Here is a letter I wrote to Chief Justice Roberts, my senators and representative, also Congressman Boehner.

Dear .....,

Please defend our Constitution by actively supporting the demands that President Barrack Hussein Obama, aka Barry Soetero, produce documentation verifying that he is eligible to assume the Office of the Presidency. This would include his vault birth certificate in Hawaii, not the ‘Certificate of Live Birth’.

The President Elect has ‘sealed’ all of his pertinent records needed to truly examine his background. This is unacceptable to the American People. It is unclear to me if he is even a legal citizen of the United States, rather than of Indonesia.

This will only apply to Democrats so Arnold would have to run as a Democrat and the Media will have to want him. If there is a candidate but the media don’t want him, or if he is a Republican, his status will be revealed long before any election.

Maybe so, maybe not. I just am one who does not want to give up on SCOTUS just yet. They can and might take some good action on January 9th if every member of Congress takes a pass and does not raise a question concerning Obama’s constitutional qualifications.

You might be right, Mark, but there is a way that courts and the powerrs that be will expose Obama. If it is clear that he has scammed the nation in getting to this position, the exposure of that scam will remove the leverage he thinks he has with the extortion threat of violence if he is not allowed to ascend on affirmative action status. The people who have been scammed will have to be told the truth by the fifth column enemedia, however. And that may be the most damning aspect, because the media don't give damn that they are fomenting mayhem and riot by not acting as the fourth estate, not vetting the candidates honestly, and not allowing truth to even trickle out if it appears neagtive toward their little affirmative action socialist god-man.

But if the executive branch--for instance--would make a public explanation fo the extent to which this mana nd his criminal Chicago minions have scammed the American election process to reap hundreds of millions in campaign funds under false pretenses, then the rioting and mayhem would be 'not happening' or at the very least, an embarrassment We The People could endure to get the lawless out int he opena nd off the streets.

Here's the problem. (I am guessing)When you file a brief before the Supreme Court you generally need much stronger documentation about whatever your topic is than Berg has presented.

He is very light on documentation unless there are other docs that we are not seeing here.

Everything he is saying is probably true but at the level he is at it should be a lot more apparent than it is. He needs a lot more accompaning data. Just a guess.

Obama (and his campaign) have never asserted that he was violating the Constitution in terms of being qualified (per that same Constitution). Their assertion is that he is qualified and since he has gone through a similar process as many prior Presidents have, in being “cleared” for office by states and by the party they are in — he’s done nothing different than many of those prior Presidents.

The real problem here — is that it is “others” who are making the assertion that he is not qualified according to the Constitution — but — they have not had any court legitimize or okay any documentation that proves such is the case.

That means that Obama is not “flouting” the Constitution — as in saying “I’m not qualified, but I’m going to take office anyway.” That’s not his position.

However, if Arnold Schwarzenegger were to run for President, it’s already *been established* beyond any doubt that he is not natural born, and thus, in his case, he would “have to say” — “I don’t care about the Constitutional requirements; I’m going to run anyway!”

You see..., that’s the big difference between Schwarzenegger and Obama. You seem to miss that point.

And also, you seem to miss the point that no one has any proof that he is not qualified and that Obama has run through the very same “process” that most all the prior Presidents have run through to get here...

In this case, you (and others) are asking for *something more* than has been required by many of the previous Presidents — basically because of your own (and others’) allegations. If there are allegations, they will have to be proven, first — before anything can be done...

It’s a lot more than more data. But, before I say anything about that..., first, Berg just wants “standing” right now, and then he’ll go back to the lower court to have it heard (and see what the result will be from that lower court).

Now, the Supreme Court is not going to consider the “evidence” on Obama that Berg is presenting, because this evidence has not be looked at and agreed upon by a court that it is valid evidence. That would have to be determined first, before the Supreme Court could ever consider it.

So, it has to go back to the lower court — first — before the Supreme Court can ever consider any of the documentation on whether Obama is qualified.

However, by the time that process winds its way through the entire system... Obama will be President and then I’m sure the Supreme Court will say that the removal of a President (if that’s the “action” that they’re asked to take, and there has to be “some remedy” asked for, I would think) is in the hands of the Congress. And also, it’s in the hands of Congress to appoint a Special Prosecutor, if they find need of *verifying* the data on Obama, as to whether he’s qualified or not....
