Why is it even in the courts? The people voted after much debate - the proposition needs to move into the signed law category.

So what? They will just go back to the ballot again. If they lose they will go back to court. If they lose that they will go back to the ballot again.

At some point, Obama and the Dems will have appointed enough judges for this crap to pass.

We lose no matter what.

Prop 8 is more than just a signed law. A law, voted on and passed, banning same sex marriage, was shot down, declared unconstitutional according to the State Constitution.

So, Prop 8 which provided for an Amendment to the State Constitution, was voted on and passed, 52% to 48%. Now, the Pillow Biters are trying to say that the Constitution is unconstitiutional. Tell me how this isn't a judicial coup attempt...

Personally, since the job of the California State Supreme Court is to measure all laws against the State Constitution, I have to wonder, WTF?
