Eric Holder: Bloggers and People I Pick are Hate Group Members

The Muffled Oar has reviewed the text of an amendment to the Matthew Sheppard Hate Crimes bill which appears to be headed for law. It expands Federal power and allows the Department of Justice to criminally charge those who attack gays, but not preachers who are attacked for their religious views.

An amendment added in conference committee with the support of the Obama/Holder Justice Department radically expands the power of the Federal Government to target political enemies and those exercising their point of view on … blogs. The Muffled Oar broke the story how the DOJ Blog Squad is monitoring and targeting conservative blogs and whipping liberal blogs into line. Amendments to H.R. 2647 allow the Attorney General to designate anyone as a hate group. You read that right – anyone. It also allows the Federal Government to introduce evidence that if you are blogging or participating in an online discussion at a webpage with an arguably racist agenda, then you can be deemed a hate group.

I can’t see how this could stand in court. In the end, the whole “hate group” thing would need to be thrown out and whatever actual “crime” one did would remain.

Hate crime is a misnomer. There is only crime. If one commits a crime, with malice towards another, that only speaks to motive. Having motive, a prosecutor sees a clear path to conviction. No special dispensation is required.

Individuals known to be involved in online activities with a hate group, including being engaged in online discussion groups or blog or other postings that support, encourage, or affirm the group’s extremist or violent views and goals.

That is an extremely low threshold and could easily include this site as well as most other conservative sites. Holder can determine his own definition of "extremist". Jim Thompson clearly qualifies, I mean urging the "overthrow" of the O, how radical can you get.
