But if, in the interest of scoring political points, Republicans in the Senate refuse to exercise that responsibility, I must act in the interest of the American people and exercise my authority to fill these positions on an interim basis.

I would just place into the record whatever it was that Dick Durbin, et. al., said when Bush appointed John Bolton this way.
Lets see... Senate democrats sit on Bush nominations... the positions go unfilled... Bush does nothing about it.
Senate republicans sit on Obama nominations... Obama acts.
I’m sorry, and I may not have all the facts... but on the face of this story, it seems like Obama has succeeded where Bush has failed.

If the nominee was voted down in the Senate, with a majority of Democrats, how can it be legal for the executive to then appoint the nominee who has already failed when voted upon as prescribed by law?
