The argument is this, If the Federal government abdicates its Constitutional duties (which it has) which are to protect American borders and protect the American people, is a State within the Constitution if that State enforces Constitutional laws that the Federal government refuses to enforce?
Clinton appointee Judge Susan Bolton is symptomatic of everything that is wrong with America. She has made herself complicit in the Federal governments violation of the Constitution of the United States of America. We are no longer a nation of laws; we are now, a nation of progressive judicial rulings.(see article)
Judge Bolden did not rule on the facts of Arizonas immigration case nor did she rule on the law. Instead Judge Bolton ruled on the nonsensical what if arguments that the Barry Hussein Soetoro administration have been floating in the Progressive Leftwing Media. (Complaint)(Response)(Decision)

I believe this ruling will serve to make states all the more eager to pick up the job that the Federal govt. isn’t doing.
How would she rule if this were a Bush lawsuit? What if indeed.
The only way to beat these America hating politicians is to vote them out of office replacing with true conservatives and a president that appoints federal judges/magistrates that interpret the law (instead of making it from the bench).

I hope “senator” Kyl likes having egg on his face.
1. If the states make use of the agencies, processes and tools that the federal government is to make available to them via federal code, then the use of federal agencies, process, and tools constitutes placing an undue burden on the federal government.
2. If the states force the federal government to comply with their legitimately passed laws from Congress, this is a violation of supremacy because it interferes with the federal governments power to choose to not enforce federal law.
