Birthright citizenship has got to end

No doubt in part to the poor economy, birthright citizenship has become a target for lawmakers.

Lawmakers in at least 14 states have said they are committed to passing the legislation targeting birthright citizenship. Arizona's anti-illegal-immigrant bill, SB-1070, was also based on model legislation that could be easily copied by states, and at least seven states are likely to pass bills similar to the first Arizona immigration overhaul this year, according to one analysis by an immigrants rights group.

It is argued that the 14th Amendment was intended to cover freed slaves. In the 19th century the Supreme Court found that the Amendment also covered the children immigrants but SCOTUS has not dealt with the children of those who have violated the law in breaking into this country illegally.

It is estimated that as many as 8% of the births in the US are to illegal alien parents.

According to the Pew Hispanic Center, approximately 340,000 of the 4.3 million babies born in the United States in 2008 were the children of illegal aliens, many of whom emanate from Mexico. The study which was released yesterday comes as more and more Americans are showing concern over illegal aliens entering the U.S. and garnering a treasure-trove of benefits such as free education, health care, and other social programs. Some conservative lawmakers wish to amend the 14th Amendment from which the court have derived the concept of "anchor babies."

Declare the local hospital delivery room to be Mexican sovereign territory like an embassy. Then, whoever is born there is a Mexican. Problem solved.

The country’s being swallowed alive. Illegals are reproducing us out of existence and the politicians not only love it, but are facilitating and cheering it on. The nation is being literally murdered before our eyes.

Just declare that kids born to illegals are not subject to the jurisdiction of the United States, and that removes any thought of 14th Amendment citizenship. We still have to worry about what to do if those kids later commit crimes, but at least they can’t claim citizenship so we can declare them persona non grata.

14th amendment citizenship is a myth. The 14th states that if a person is born on U.S. soil and has allegiance to(subject to) the U.S. then that person is a U.S. citizen.

The 14th amendment myth is just another liberal way of rewriting the Constitution.

That such declaration is even necessary is the result of a legal myth.

The words "subject to" have no meaning when used in the 14th A if they are not understood to mean "exclusive jurisdiction" which they were at the time. That is because every human within the U.S. is subject to the jurisdiction.

Illegals may immediately go to any Mexican (or other) embassy and be recognized as citizens and receive all manner of relief. Thus, they are not under the exclusive jurisdiction jurisdiction of the U.S.

Just secure the borders. Birthright citizenship will not be a problem. The political hacks selling the abolition of jus soli are just seeking cover for their failure to stop the invasion.

If Arizona’s experience is any example, no matter what individual states do, the Feds will immediately slap them down and claim sole jurisdiction over determining who’s a citizen. Eventually the Supremes will have to weigh in.

Can’t Congress just ask the Supremes now for an opinion absent a case? Just tell everyone what the 14th Amendment means. If they say it means anyone born here is a citizen, then Congress can immediately draft an amendment to exclude children of illegal aliens.

Seems like we’re dragging our feet to the fight and taking the long way around.

You are exactly right. I see it big time where I live. We not only need to dump the anchor baby provision but retro actively to like 1990 or so. Even if we stopped it today there are so many illegal babies that it WILL be the ticking time bomb that will go off and make us a permanent socialist state.
