UPDATE: Jerome Corsi To File Criminal Charges..
BirtherReport ^ | 5/23/11 | unknown

[UPDATE BELOW, AUDIO FOUND] WND's Dr. Jerome Corsi stated on the Bill Cunningham Radio Show that he's going to 'file criminal charges against the White House' over the latest birth certificate forgery. I listened to the live show and then went back to the radio station website to download the show podcast and lo and behold the interview with Dr. Corsi was scrubbed from the show podcast. I think maybe Bill O'Reilly gave them some tips on scrubbing show podcasts... ;-)

The radio station in question is Cincinnati's 700 WLW which is owned by none other than Clear Channel Communications, which, by the way, is the parent company of Clear Channel Outdoor who refused to erect World Net Daily's 'Where's the Birth Certificate?' billboards two years back.

God bless the man. He has certainly stuck his neck out for the past two years trying to get to the truth. The stacked courts will probably instill delays until after the election. I would think the American people have had enough of O. by now anyway.

If Corsi gets sued over the BC its then in play for inspection and a ruling on authenticity. This could get hot.

“WND cannot release the identity of the confidential source without risking the person’s life.”

Now why would that be...Donald Young and Lt. Quarles Harris.

Corsi is an idiot. He isn't a prosecutor, which means he can't file any charges. The most he can do is file a complaint with a prosecutor, who will promptly laugh in his face.

That's what I was thinking. If he actually has the goods, he may welcome a lawsuit.

Corsi mentioned that he has several contacts inside the HDOH working there. They alerted him to the fact that a forgery was being prepared and was utlimately placed into Obama’s file.

These people are the whistleblowers. They go with the media in tow together with Tim Adam’s affadavit and claim a criminal act has taken place.

Bump.

Anybody can file a criminal charge against anybody else, afaik. But if the local jurisdictions don’t agree to go along with it, you would have to be ready to act as prosecutor yourself.

Dude, where are you getting your information? That's just wrong.

A citizen can file a criminal complaint, but only a prosecutor can file charges acting on that complaint.

If the prosecutor thinks your complaint is nonsense, then you're out of luck and no charges will be filed and no one will be prosecuted.

And no, you can't act as prosecutor yourself if the prosecutor refuses to act on your complaint.

Can you image what chaos would ensue if anyone could just willy-nilly start acting as a prosecutor against anyone they liked?

The courts cannot possibly act in the way you describe.

That makes them a “private” court system that serves at the will of the prosecutor.

In fact I investigated it a bit more after I made that statement.

Here is a website that spells out the procedures for a person in Maryland to file a criminal charge:

http://www.courts.state.md.us/district/selfhelp/crimes.html

The courts cannot possibly act in the way you describe.

That's exactly how they act. Even in Maryland. From your link:

Step 1: Report the crime to the police...

Step 2: File charges with a District Court commissioner If the police do not conduct an investigation or file charges, you may file an Application for Statement of Charges on your own with a District Court commissioner.

A District Court commissioner, a judicial officer, reviews the Application for Statement of Charges to decide if sufficient evidence exits to charge the defendant (the person accused) with a crime (probable cause).

Note the decision to file criminal charges is with the district court commissioner. The citizen can apply to the comissioner to file charges, but he can't file charges himself.

That makes them a “private” court system that serves at the will of the prosecutor.

No, because the prosecutor (or court comissioner) is a public servant, either an elected official or someone appointed by an elected official. Hence he is an agent of the people.

The District Court commissioner is part of the court.
The clerk is part of the court.

The prosecutor IS NOT part of the court, he may be a “party to an action”. It’s that old separation of powers thingy.

If paperwork is filed with the clerk of the court or the commissioner, AND THE PAPERWORK IS IN ORDER, the court must act. Regardless of who filed the paperwork.

Should read: “Update: Jerome Corsi to embark on latest round of attention whoring.”

And read: “Update: El Sordo to continue to shill for a criminal syndicate aka the Obama Administration”.

If you thought identity fraud, social security fraud, and forgery to name a few were not crimes worth prosecuting then why concern yourself where 4 trillion dollars from our national treasury have gone in the past 2+ years of this criminal enterprise.

Especially if you don’t pay taxes, right? OPM...

The prosecutor is an officer of the court as well.

If paperwork is filed with the clerk of the court or the commissioner, AND THE PAPERWORK IS IN ORDER, the court must act.

Nope. According to your link, the commissioner can deny the application, and not file criminal charges, if he does not think a crime took place.

Besides, Maryland is an outlier. In the vast majority of states, it is totally up to the prosecutor whether to file charges. For example, in Washington state:

How to file criminal charges.
The Prosecuting Attorney does not investigate cases. We receive our cases directly from the police. If you want criminal charges to be filed, you must first contact the police agency where the crime occurred...

...The Prosecuting Attorney files charges on behalf of the citizens of the State of Washington for crimes committed in King County.

Also in New Jersey, the prosecutor has full discretion on whether to file:

Once a criminal complaint is filed it will be forwarded to either the County Prosecutor’s Office or the municipal court. All complaints involving crimes or a combination of crimes and disorderly persons offenses will be forwarded to the County Prosecutor’s Office for review. Criminal complaints involving only disorderly persons offenses will be forwarded to the municipal court. The municipal court will advise the complainant and defendant of the hearing date.

When a criminal complaint involving a crime or a combination of crimes and disorderly persons offenses is forwarded to the County Prosecutor’s Office, the County Prosecutor’s Office will review the case. The County Prosecutor’s Office will review the complaint, obtain the relevant police reports, and where indicated contact the complainant or victim and/or the investigating officer. After reviewing the case, the County Prosecutor’s Office will determine the appropriate course of action.

The County Prosecutor’s Office has broad discretion to determine the appropriate disposition for a complaint. The Prosecutor’s office may handle a criminal complaint in several different ways. The complaint may be administratively dismissed, remanded to municipal court, or prosecuted in Superior Court.
