This case was filed against the registrar Alvin Onaka and Director of Health Loretta Fuddy, seeking access to the original birth certificate of Barack Obama for expert examination.
If you are a tea party member in HI, please, relate this message to the Tea Party members, Republican party members or any decent resident of HI, who wants the truth and justice to prevail. Please, relate this message to the local media.

I’m an attorney too and unlike you I find the evidence attention-getting and the legal issues fascinating. Some enterprisimg 2L on law review could really have some fun doing a thorough exploration of the standing problem. Maybe someone already has. I haven’t poked around in the journals lately. Maybe there’s a CLE that would cover it. Or not. But they are doing more out of the box stuff. Which is good, because I nearly fell asleep during my estates CLE. Just sayin...

Taitz’s strategy all along was to file this case in HI State Court and if thrown out appeal with the 9th Circuit where she already has one case pending (conjoin the cases?). Either way it will not be over in 2 minutes as someone on this thread has claimed...

Well, there is no way Dr. Taitz can lose here, because she either gets what she wants, or she is once again pushed away by all that technical law stuff. Either way, she lives to fight another day!!! If Obama and the Obots are stupid enough not to go to court and put an end to this, it will just be one more win in the Court of Human Opinion.

And, yeah ... CLEs are some good sleeping time. The best I ever took though was early in my career by a Federal Court District Judge that was simply entitled, “how to try a case”. I settled in, ready to snooze and was riveted the entire time. Changed the way I approached litigation and I was so much better as a result. Was a two day seminar ... on the weekend, and I still looked forward to going.

That is absolutely correct. Unless you have evidence, it is nothing. When an investigator came to me with facts, evidence, he had to have something concrete. I’ve seen neigh unto nothing on this issue to convince me it is anything more than a canard. It is tilting at windmills.

Discovery can not be a fishing expedition. It must be based be show to reasonably appear to lead to admissible evidence. Mere assertion means nothing. And you can not have discovery absent a pending suit (except in the rarest of circumstances)

I’m not a lawyer, but I think the trajectory to a federal Circuit Court is from a federal District Court. You have to begin at the District Court level, claiming violations of federal law. Then, if you lose there, you go to the appeals court, I don’t think one goes from a municipal or state court to a federal appeals court, with the exception of the DC Court of Appeals, and then IIRC it’s straight to SCOTUS.

You could be right, but I think that there will be a lot of voters come election day Nov. 2012 who will vote against Obama because of the way Obama has been so secretive about his background during the 2012 presidential campaign.
For instance, it has been nearly six months since Obama released his long form birth certificate to the public on April 27, yet Kapiolani Hospital has not said one word to verify that Obama was born there as it is stated on the long form birth certificate.
It would take a simple phone call from the President of the United States to Kapiolani officials---and put a deadly dagger into the heart of birther nation---for those officials to verify tomorrow that Obama was indeed born there, for those officials to allow reporters to examine Obama's records, and for the officials to point out the room where Obama's mother stayed in 1961, but Kapiolani and Obama are conspicuously silent. Why is that?
Could the answer be a simple one: Kapiolani officials are conspicuously silent because Obama was not born there as Obama claims, so there are no Obama records for anyone to look at, and there is no hospital room where Obama's mother stayed in 1961.
